<br /> .. <br /> '. <br /> . (12) Such other factors which are relevant to the <br /> purposes of Chapter 9.6. <br /> (E) Time for Acting on Application. The City Council shall <br /> act on an application in the manner described above within <br /> thirty (30) days from receiving a completed application, <br /> except that where additional information is required <br /> pursuant to Section 9.6-38(D). In which event the City <br /> Council shall render a written decision wi thin thirty (30) <br /> days from the receipt of such additional information. <br /> (F) Conditions Attached to Special Use Permits. Upon <br /> consideration of the factors listed above and the purpose <br /> of Chapter 9.6, the City Council shall attach such <br /> conditions to the granting of Special Use Permits as it <br /> deems necessary to fulfill the purposes of Chapter 9.6. <br /> Such conditions may include, but are not limited to, the <br /> following: <br /> (1 ) Modifications of waste treatment and water supply <br /> facilities. <br /> (2) Limitations on period of use, occupancy, and <br /> operation. <br /> (3) Imposition of operational controls, sureties, and <br /> . deed restrictions. <br /> (4) Requirements for construction of channel modifica- <br /> tions, compensatory storage, dikes, levees, and <br /> other protective measures. <br /> ( 5 ) Flood proofing measures, in accordance with the <br /> State Building Code and Chapter 9.6. The applicant <br /> shall submit a plan or document certified by a <br /> registered professional engineer or architect that <br /> the flood proofing measures are consistent with the <br /> Regulatory Flood Protection Elevation and associated <br /> flood factors for the particular area. <br /> ARTICLE XI. NON-CONFORMING USES <br /> Section 9.6-39. A structure or the use of a structure or premises <br /> which was lawful before the passage or amendment of Chapter 9.6 but <br /> which is not in conformity with the provisions of Chapter 9.6 may be <br /> continued subject to the following conditions: <br /> . <br /> 24 <br />
