<br /> <br /> <br /> <br /> <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF ARDEN HILLS <br /> <br /> ORDINANCE N0. e,43 <br /> <br /> AN ORDINANCE ADDING CHAPTER 9.6 TO THE ARDEN HILLS <br /> MUNICIPAL CODE AND REPEALING CHAPTER 9.5 RELATIVE <br /> TO THE FLOOD PLAIN MANAGEMENT. <br /> <br /> The Arden Hills City Council ordains that Chapter 9.6 and its <br /> subdivisions are hereby added to the Arden Hills Municipal Code to <br /> read as follows: <br /> <br /> CHAPTER 9.6 - FLOOD PLAIN MANAGEMENT <br /> <br /> ARTICLE I. STATUTORY AUTHORIZATION, FINDINGS OF FACT AND PURPOSE <br /> Section 9.6-1. Statutory Authorization: This regulation is enacted <br /> pursuant to the provisions of M.S. 103F and 462.357, which outlined <br /> local government units to adopt regulations designed to minimize <br /> flood losses. <br /> Section 9.6-2. Findings of Fact: <br /> <br /> (A) The flood hazard areas of the City of Arden Hills, <br /> Minnesota, are subject to periodic inundation which <br /> results in potential loss of life, loss of property, <br /> health and safety hazards, disruption of commerce and <br /> governmental services, extraordinary public expenditures <br /> or flood protection and relief, and impairment of the tax <br /> base, all of which adversely affect the public health, <br /> safety, and general welfare. <br /> (B) Method Used to Analyze Flood Hazards. This Ordinance is <br /> based upon a reasonable method of analyzing flood hazards <br /> which is consistent with the standards estabZished by the <br /> Minnesota Department of Natural Resources. <br /> Section 9.6-3. Statement of Purpose: It is the purpose of this <br /> Ordinance to promote the public health, safety, and general welfare <br /> and to minimize those losses described in Section 9.6-2(A) by <br /> provisions contained herein. <br /> ARTICLE II. GENERAL PROVISIONS <br /> <br /> Section 9.6-4. Lands to Which Ordinance Applies: This Ordinance <br /> shall apply to all lands within the City of Arden Hills as shown on <br /> the Official Zoning Map and/or the attachments thereto as being <br /> located within the boundaries of the Floodway, Flood Fringe, or <br /> General Flood Plain Districts. <br /> <br /> 1 <br />
