<br /> AN ORDINANCE AMENDING SECTION I.,
<br /> NLNSANCES, OF CITY COOE
<br /> The Arden HlHs City Council hereby ordains:
<br /> Section 16 of the City Code is amended to include
<br /> the following language:
<br /> Section 16-2 (8) Noxious weeds and/or objectionable .
<br /> Of unsightly plant growth twelve (12) inches or greater
<br /> in height
<br /> It shall be unlBWfuI for any owner, IMs8El or occu.
<br /> pant, or any agent, servant, representaItve or employee
<br /> of any such owner, lessee or occupant nailing control
<br /> of any occupied or unoccupied lot or lal'ld or any part
<br /> thereof in the City 01 Arden Hills to permit or malntaln
<br /> on any sYch 101 or land, or on or along the sidewalk,
<br /> street or alley adjacent to the same betWeen the pro-
<br /> perty line and the curb or middle of the alley or for len
<br /> feel outside the property line II there Is no curb, any
<br /> growth of weeds, grass or other rank vegetation to a
<br /> grealer height than twelve (12) inches on the average,
<br /> or any accumulation of dead weeds, grass or brush.
<br /> II shall also be unlawful for any such person or person
<br /> to cause, suffer or allow poisorl ivy, ragweed or other
<br /> poisonous plant or plants detrlnlental to health to grow
<br /> on any such 101 or land In such manner that any part
<br /> of such ivy, ragweed, or other poisonous or harmful
<br /> weed shall extend upon, overhang or border any public
<br /> place Of allow the seed, pollen or other poisonous par-
<br /> licles or emanations therefrom to be carried through
<br /> the air into any public place
<br /> Section 16-2(a-1) It shall be the duty of any owner,
<br /> lessee or occupant ohny lot or land to cut and remoye
<br /> or cause to be cut and removed all such weeds, grass

<br /> as may be necessary to comply with the provisions of
<br /> Section 16-2 (a); provided that cutting .and removing
<br /> sUch weeds, grass and vegetation alleast once in every
<br /> three weeks, between May 15 and September 15 shall
<br /> be deemed to be compliance with Ihls Ordina~.
<br /> Section t6-2 (a-2) If the provisions of the foregoing
<br /> seclians are nol complied with, the Weed Inspector
<br /> shall ~rve written notice upon the owner, lessee or oc-
<br /> cupaM or any p$l$On having the care or control of any
<br /> such .IDI or land to comply with the provisions of this
<br /> Ordif1l!mce.
<br /> If the persOn upon whom the nolice is served fails,
<br /> neglects or refuses to cut and remove or to cause to
<br /> be cut and removed such weeds, grass or other vegeta-
<br /> tion wilhin five (5) days after receipt of such notice, or
<br /> if no person can be found in the City of Arden Hills who
<br /> either is or claims to be Ihe owner of such lot or land
<br /> or who either represents or claims to represent such
<br /> owner, the Weed Inspeclor shall cause such weeds,
<br /> grass and other vegetation. on such lot or land to be .
<br /> cllt and removed and the actual cost of such cutting
<br /> and removal, plus eight (80/0) percent for insp8ction and
<br /> other additional eo&Is in connection therewith, shall be
<br /> certified 10 the County Auditor and shall thereupon
<br /> become and be asse,sed againstlne lot or land on
<br /> which such weeds, grass and otner vegetation were
<br /> located alld shall be added 10 and become part of the
<br /> taxes nexl to be assessed and levied upon such lot or
<br /> land and shall bear interest Btlne same rate as taxes
<br /> and shall be collected and enforced by the same of.
<br /> fice and in the same manner as taxes,
<br /> Section 16-2 (a-3) Any person who shall neglect to
<br /> cui and remove weeds, grass or other vegetation as
<br /> dIrected in this ordinance, or who shall fail, neglecl or
<br /> refuse to comply with lhe provisions of this ordinance
<br /> or who shall resist or obstruct the Weed Inspeclor or
<br /> his employees in the cutting and removal 01 weeds,
<br /> grass and other vegetation, shall, upon conviction
<br /> thereof, be subject to a ftne of nOlless than $25.00 nor
<br /> more than $500.00 and each day on which such viola-
<br /> tion continues shall c'onstitute a separate offense
<br /> EFFECTIVE DATE: This Ordinance shaH be effec-
<br /> live from and alter its passage and publication.
<br /> Adopted by the Arden Hills City Council this 31st'tlay
<br /> of July, 1989.
