<br />RECEIVED <br /> <br />STATE OF MINNESOTA APR - 4 2002 <br />COUNTY OF RAMSEY <br />I CITY OF ARDEN HILLS (iITYOF ARDEN HILLS <br /> <br />SPECIAL USE PERMIT CASE NO. 02-01 <br /> <br />The undersigned, Administrator for the City of Arden Hills therein "City") certifies as <br />follows: <br /> <br />1. That an application for a Special Use Permit was submitted by AT&T Wireless, <br />(herein "Permitees") requesting that the City issue a Special Use Permit which <br />will allow the Permittee to install, operate and replace receiving antennas on the <br />roof of the municipal water tower located at 4251 Femwood Avenue in strict <br />conformance with plans, specifications, narrative and pictorial descriptions, <br />sketches, transparencies, planning reports and other documentation submitted to <br />and filed with the City in connection with the above referenced Planning Case. <br />The parcel is located at 4251 Femwood Avenue on the following described real <br />property situated in Ramsey County, Minnesota, to-wit: <br /> <br />W 190 ft. of N 150 ft of S 162 ft of E 1/2 of SE 1/4 (subj. to Rd.) in Section <br />22, Township 30, Range 23, Ramsey County, Minnesota. <br /> <br />2_ That such application complied with the City's zoning regulations; <br /> <br />3. That the application was reviewed and a public hearing was held by the City's <br />Planning Commission on the 6'" day of March, 2002; and, <br /> <br />I 4_ That the application, supporting data, and Planning Commission's <br />recommendations were reviewed by the City Council on the 25th day of March, <br />2002, at which time the City Council granted the Special Use Permit which allows <br />the Permittee, its successors and assigns, to install, operate and replace <br />receiving antennas subject to the following conditions: <br /> <br />4.1 No additional screening required by the Zoning Ordinance is <br />necessary. <br /> <br />4.2 The antennas and all mounts shall be painted to match the color of <br />the tower <br /> <br />4.3 No welding shall be done on the water tower tank shell. <br /> <br />4.4 The antennas shall not exceed 12' in height. <br /> <br />4.5 A lease agreement shall be maintained with the City of Arden Hills <br />which details rent payments and other specific requirements of the <br />Cily. If at any time, the lease shall be terminated or expire, the SUP <br />shall be reviewed and the City may impose other restrictions or <br />conditions as warranted including revocation of permit. <br /> <br />5_ Any violation by Permittee, its successors or assigns, of the provisions of this <br />. Special Use Permit shall be deemed a violation of the Arden Hills Zoning <br />Regulations entitling the City of the various remedies provided therein. <br /> <br />6_ A certified copy of the Special Use Permit shall be filed by the City Administrator <br />with the Ramsey County Recorder or Registrar of Titles.
