<br /> I <br /> I <br />"Prior Redeveloper Improvements" means the improvements being constructed by the .. <br />Redeveloper on the Redeveloper Property, consisting of an approximately 154,000 square foot <br />office/warehouse building. <br />"Project" means the City's Municipal Development District No. I established by the City I <br />pursuant to the Development Program relating thereto. <br />"Project Area" means the real property located within the boundaries of the Project. I <br />"Public Improvements" means the improvements to be constructed by on or behalf of the I <br />Authority or the City pursuant to Section 3.5 of this Agreement. <br />"Redeveloper" means Welsh Companies, a Minnesota corporation, its successors, assigns I <br />and any future owner of any interest in any portion of the Redevelopment Property. <br />"Redeveloper Property" means the property described as such on the attached Schedule A I <br />on which the Redeveloper is constructing the Prior Redeveloper Improvements. <br />"Redevelopment Property" means the real property described in Schedule A of this I <br />Agreement. <br />"State" means the State of Minnesota. .. <br />"Tax Increment" means that portion of the real property taxes paid with respect to the I <br />Redevelopment Property and Minimum Improvements (and Redeveloper Property?) that is <br />remitted to the Authority as tax increment pursuant to the Tax Increment Act. I <br />"Tax Increment Act" means the Tax Increment Financing Act, Minnesota Statutes, <br />Sections 469. I 74-469.179, as amended. I <br />"Tax Increment District" means the Tax Increment Financing District No.2 created by <br />City and administered by the Authority. I <br />"Tax Official" means any City or county assessor; County auditor; City, County or State <br />board of equalization, the commissioner of revenue of the State, or any State or federal district I <br />court, the tax court of the State, or the State Supreme Court. <br />"Termination Date" means the date that the Bonds are paid in full. I <br />"Unavoidable Delays" means delays which are the direct result of acts of God, unforeseen I <br />adverse weather conditions, strikes, other labor troubles, unavailability of materials through no <br />fault of Redeveloper or the Authority, fire or other casualty to the Minimum Improvements or the <br />Public Improvements, litigation commenced by third parties which, by injunction or other similar -- <br />judicial action, directly results in delays, or acts of any federal, state or local governmental unit <br />5 I <br />
