<br />- <br />I ~ <br />I ~~~ <br />II · CITY OF ARDEN HILLS )0/1'1\"17 <br /> MEMORANDUM <br />II DATE: October 14, 1997 <br /> TO: Mayor and City Council <br />I FROM: Brian Fritsinger, City Administrator~ <br />I <br /> SUBJECT: Resolution #97-50, Condemnation of Property <br />I Backl!round <br /> The City of Ardcn Hills has been attempting to acquirc thrce (3) parcels of propcrty from <br /> Naegele Outdoor Advcrtising (Morris Communications) for the past several months. On <br />I September 29, 1997, thc City Council authorized approval of a Sale and purchase Agreement <br /> with Naegele on these three parccls of property. <br />, The attorneys for the City and N acgele continue to undcrtake negotiations on the property. <br /> While negotiations have been amicable, Nacgele continues to request additional language in the <br />CI agreement which is causc for concern. The gTeatest concern, however, is that oftiming. <br /> As thc Council is aware, thc GBD projcct is on a very defined time line for the start of <br /> construction. Both the infrastructure construction, and Welsh building construction, arc vcry <br /> limitcd as to the ability to be delayed. Each time thc Naegelc attorneys request additional <br /> language, it only serves to delay the closing date and noticc to vacate to their tenants. <br /> The adoption ofthe resolution is not intended to diTect staff to immediately begin condemnation <br /> proceedings. Staff fully intends to continue ncgotiations and try to resolve the pToblem in a <br /> manner acceptablc to both parties. However, should negotiations continue to be delayed, and thc <br /> City Council fully supports the Welsh proposal, the City may be in a bettcr position to resolvc <br /> this acquisition by condemning thc property. <br /> Recommendation <br /> Staffrecommends adoption of Resolution #97-50, authorizing condemnation of property in <br /> connection with Fourtcenth Strect NE Road and Utility Projcct. <br /> BF/sls <br />. <br /> ~ <br />
