I have received copies of the minutes of both the City Council and <br /> .. the Economic Development Authority, documenting the September 22, 1997 <br /> meetings. I do not have any problems with the content of the minutes, however, all of <br /> the people that I am working with are "crying" for a comprehensive list of the <br /> . remaining conditions, in a single document.ry form th.t will be ~ccept~ble to the <br /> banks ~lld the institutional invgstors' lawyers. Can I get an updated letter detailing all <br /> of the current conditionst <br /> I 2. Nael!ele. We were infomled yestcrd~y by Jerry Filla, the City Attorney, that there is <br /> not yet any documentation ~v~ilable regarding the Naegele parcels. We have, <br /> however, received preliminary title documentation regarding the Kem Milling site. In <br /> . any event, we ~re "dead in the water" until we receive evidence of title in the City <br /> regarding the Naegele parcels, together with sufficient title work so as to enable our <br /> surveyor to complete the survey, ~nd, in turn, to allow us to become confident that <br /> our final plat is indeed correc~ and allowing \Is to ~d1ieve the kind of title insurance <br /> . coverage we need in order to satisfy our banks. In other words, we cannot buy any <br /> land until the Naegele title work i.1 completed. <br /> 3. Utilities. It is essential that the utilities work under Gateway Boulevard be <br /> . completed this f.I1. In fact, the work should, we underst~lld, be commenced before <br /> October 15, 1997, to avoid extraordinary winter conditions costs. The work needs to <br /> be completed in the fal1 because we need to commence our construction in the early <br /> . spring, or we will be pl1shed way out into the wrong leasing season. In other words, <br /> we need to figure out a way to accept the portion of the Lamelli bid which involves <br /> the construction of the utilities in Gateway Boulevard, including excavation, <br /> . installalion of utilities, and backfill.
