D"''''~ <br /> SUBJECT: Community Development Department Activities <br />I December of 1996 and January of 1997 <br />I The following summarizes the activities of the Community Development Department for <br /> December of 1996 and January of 1997. <br />I Plannin!': and Zoninl:" <br /> The Planning Commission took action on the following Planning Cases at their January 8, 1997 <br /> meeting: <br />I 1. Planning Case 96-27 (Arden Hills Texaco/Quizno's, 1306 West County Road E, <br /> Special Use Permit amendment / Variance). The Planning Commission is <br />.. recommending denial (4-2) of the requested SUP amendment and variance. The <br /> recommendation is based on the following findings: <br />I a. The request does not adequately delineate the unique circumstances necessary to <br /> approve a variance; <br /> b. The granting of the requested variance, without unique circumstances, would be <br />I contrary to the intent and purpose of this section (VI, D, I, b) of the Zoning <br /> Ordinance; <br />I c. The granting of the requested variance, without unique circumstances, would <br /> effectively null the application of this section (VI, D, I, b) of the Zoning <br /> Ordinance; <br />I d. The granting of the requested variance does not appear to be supported by <br /> previous actions by the City Council. <br />I Additionally, the Planning Commission recommends that the landscaping on the west <br /> side of the site that has yet to be installed and that was required as part of Planning Case <br /> 94-24 (condition # 10) be installed before May 3 I, 1997. <br />I Generally, the discussion on this application focused on would the proposed <br />I modifications cause the "Deli" to become a principal use on the site, rather than an <br /> accessory use to the Convenience Store. If the "Deli" is a principal use, then the City <br /> Code requires a 1,320 foot separation from other fast food uses (ie., McDonald's). <br />i' <br />I <br /> .~ <br />
