In this revision, <br /> I comments that could be viewed as being editorial or endorsing of a particular view have been <br /> removed. Further, additional options and points of clarification have been added. However, <br /> because the intent of a model ordinance is to provide cities with a comprehensive guide as to <br /> .. what the may legally do to combat a particular problem, in this case underage tobacco use, it <br /> was not possible to incorporate an of the requested changes you summarized on behalf the <br /> assorted retailers' associations. <br /> I The disclaimer cover sheet for the ordinance has been revised to include the Grocers' <br /> I Association and the Retailers' Association as additional sources of information and to point out <br /> that other groups may also be available. Further, the disclaimer now more clearly states that <br /> the ordinance is only a model and should be modified to meet the needs of each particular city. <br /> 1 To achieve that goal, the disclaimer also encourages cities to work with the merchants in the <br /> drafting of the ordinance. <br /> 1 In section 500, language was added that states that while a city has the authority to deny a <br /> license for the stated grounds, it does not have to unless otherwise required by law. Language <br /> was also added to the notes field reminding cities of the need to provide due process and to not <br /> I act arbitrarily and capriciously. The grounds themselves, however, were not modified as they <br /> are representative samples of what the courts have said are valid grounds for denying a <br /> license. <br /> I Because this model is intended to be a comprehensive guide, item C was not removed from <br /> I Section 600.
