<br /> " , . <br /> - <br /> WHEREAS, the Minnesota Department of Transportation has determined the storm sewer is <br /> eligible for State Aid funds. - <br /> NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: . <br /> 1. The County shall prepare the necessary plans, specifications and proposals. Cost of project revisions I <br /> after completion of plans and specifications will be paid for by the party requesting the revisions or I <br /> as defined by supplemental agreement. Revisions must be consistent ,vith State Aid requirements <br /> and are subject to County approval. <br /> 2, The County shall take bids, and with concurrence of the City, award a contract for the construction of I <br /> this subject project; the County shall perform the construction inspection; the City shall assist the <br /> County in the inspection of City utilities and landscape features. The City shall take primary I <br /> responsibility for inspection of utility betterments, specialty landscape features, and other amenities <br /> paid for and owned by the City. <br /> 3. The County shall administer the acquisition of all rights of way and easements required for the I <br /> constmction of the project. The County shall provide all compensation to property owners for <br /> acquired rights of way and easements. I <br /> 4. All County road rights of way and temporary easements will be in the name of the County, and <br /> parking and other regulations will be controlled by the County. Any rights of way which cannot be I <br /> negotiated will be acquired through eminent domain proceedings by the County. <br /> 5. The County and City shall participate in the costs of construction in accordance with the Estimated .1 <br /> Cost Participation Summary, attached as Exhibit A and incorporated herein, except as modified <br /> below. <br /> 6. The County and City shall participate in the costs of storm sewer constmction to the extent identified I <br /> by the Mn/DOT Hydraulics Engineer's Memorandum on storm sewer cost participation percentages. <br /> 7. Upon completion of the project the County shall own and maintain all storm sewer catch basins, I <br /> leads and outfalls which are located within County road rights of way and direetly serve the paved I <br /> portion of Highway 96 or interseeting County roadways, The City shall own and maintain, within its <br /> political boundaries, all stom1 sewer tmnk lines and storm sewer laterals servicing property outside <br /> the paved portion of Highway 96 or intersecting County Roadways. It is acknowledged that I <br /> detention and sedimentation ponds constmcted in the City of Shoreview serve a watershed function. <br /> Shoreview shall own and maintain both pond areas. However, maintenance and operations costs <br /> associated with the two pond areas constmcted as part of this project shall be shared by Ramsey I <br /> County, the City of Arden Hills, and the City of Shoreview commensurate with their respective <br /> contributing watershed areas, weighted to reOect an appropriate mnoff coeficient. Respective cost <br /> share perccntages for Pond Number 4 (Pond A) shall be 33% County, 3% Arden Hills, and 64 % I <br /> Shoreview. Respective cost share percentages for Pond Number 5 (Pond B) shall be 66% County, <br /> 0% Arden Hills, and 34% Shoreview. Shoreview committment to this cost share provision shall be <br /> included in County Agreement 97001 between Ramsey County and Shoreview. I <br /> 8.
