MEMORANDUM <br /> DATE: May 12, 1997 <br /> I TO: Mayor and City Council <br /> Kevin Ringwald, Community Development Director~ <br /> I FROM: <br /> SUBJECT: Resolution 97-27, Accepting Quit Claim Deed for various portions of <br /> I excess MnDOT right's-of-way adjacent to STH #51 <br /> I Introduction <br /> The Staff requests that the City Council endorse Resolution 97-27 and authorize the City <br /> Attorney to file a Quit Claim Deed from the Minnesota Department of Transportation (MnDOT) <br /> I to the City of Arden Hills (Exhibit A). <br /> Backe-round <br /> I The City Council on August 14, 1995 approved a request (site plan) by Bethel College to <br /> construct a parking lot adjacent to STH #51 (Planning Case 95-18). As a part of that request, <br /> Bethel College requested the City's assistance in obtaining ownership to the Hamline Avenue <br /> .. Service Road which parallels STH #51 and services only Bethel College. Bethel College, for <br /> some period of time, has been maintaining this roadway as ifit were their own, since MnDOT <br /> has not maintained the roadway. <br /> I The State of Minnesota cannot directly release excess property to individuals or corporations. <br /> I However, the State can release these same properties to municipalities. City's can release excess <br /> property to individuals or corporations. The City Council concurred with Bethel College's <br /> request for the City to act as a facilitator in this transaction at that same meeting in August of <br /> I 1995. <br /> In reviewing what is excess right-of-way, MnDOT evaluated all of their right-of-way in the <br /> I vicinity of the request (Exhibit B). MnDOT has determined that the portion requested by Bethel <br /> College, via the City, is excess right-of-way. MnDOT has also determined that Hamline Avenue, <br /> north of County Road E and south of the railroad tracks is excess, as well as, the frontage road <br /> I which connects Grey Fox Road and Red Fox Road. The State of Minnesota has executed a Quit <br /> Claim Deed which transfers these three properties to the City of Arden Hills. <br /> I The Staff intends to request the City Council to transfer the Hamline A venue Service Road, north <br /> of the railroad tracks, to Bethel College at the Tuesday, May 27,1997 meeting. <br /> I <br /> t' <br /> I <br />
