<br /> . - - - - - . - - - .'-'- <br /> 1f(] I <br /> I <br /> EASEMENT AGREEMENT .. <br /> THlS EASEMENT AGREEMENT, is made and entered into as of the _ day of <br /> , 1997, by and between WELSH DEVELOPMENT COMPANY, LLC. a I <br /> Minnesota limited liability company ("Welsh") and the CITY OF ARDEN HILLS, a Minnesota <br /> municipal corporation (the "City"). <br /> WITNESSETH: I <br /> WHEREAS, Welsh is the fee owner of certain real property located in Ramsey County, I <br /> Minnesota, legally described on Exhibit A attached hereto and incorporated herein (the "Welsh <br /> Property"); and <br /> WHEREAS, the City desires to maintain a cul-de-sac turning area at the end of a public roadway I <br /> known as 14'" Street Northeast ("14'" Street") on a portion of the Welsh Property as legally <br /> described on Exhibit B atlached hereto and hereby made a part hereof (the "Cul-de-sac Turning I <br /> Area") until such time as 14th Street is extended southeasterly of its current most southeastern <br /> point; and <br /> WHEREAS, the parties hereto desire to enter into this Easement Agreement to grant to the City a I <br /> temporary, non-exclusive roadway easement (the "Easement") over the Cul-de-sac Turning Area. <br /> NOW, THEREFORE, in consideration of the foregoing Recitals and for other good and valuable fJ <br /> consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto <br /> hereby agree as folIows: I <br /> I. Declaration of Easement Over Cul-de-Sac Turning Area. Welsh hereby warrants <br /> and covenants that it is the owner in fee simple of the Welsh Property and hereby grants I <br /> and conveys unto the City for use by the City and their respective agents, employees, <br /> tenants, occupants, licensees and invitees, a non-exclusive appurtenant easement for <br /> roadway purposes over and across the Cul-de-sac Turning Area. I <br /> . <br /> 2. Interference With Cul-de-sac Turnini! Area. No obstructions which would <br /> prevent, restrict or otherwise hinder the reasonable passage of pedestrians or the I <br /> maneuvering of vehicles over any portion of the Cul-de-sac Turning Area $hall be erected, <br /> condoned or permitted 10 endure, nor shall any other conduct, passive or affirmative, be <br /> permitted which would in any manner restrict the rights of tho: panies hereto, their agents, I <br /> employees, tenants, occupants, licensees and invilees, to fully utilize the Cul-de-sac <br /> TUrning Area for the purposes permitted herein; provided, however, that the City may <br /> from time to time $el up such structures as may be reasonably necessary to protect the I <br /> public safety and to perform necessary maintenance and repairs to the Cul-de-sac Turning <br /> Area. <br /> I <br /> .. <br /> I <br />
