<br /> I' <br /> I 2. Cumulative Dotential effects ofrelated or anticipated future proiects <br /> The project in this development proposal is essentially a one-time effect. There are <br /> -- currently no anticipated future development projects which are associated to this <br /> development proposal. The prevention and mitigation measures described in the proposal <br /> and that have been recommended by the Planning Commission are established to <br /> I minimize the long term or cumulative effects of this project. <br /> 3. The extent to which the environmental effects are subiect to miti~alion bv om!Oin~ public <br /> I re~ulatorv authoritv <br /> The project in this development proposal is one-time effect. Therefore, the ongoing <br /> public regulatory authority over the project is limited to those agencies who the developer <br /> I is required to receive approval from prior to commencement of the project. The approval <br /> of and compliance with the permit requirements of these agencies will be a condition of <br /> the Planned Unit Development. The list of agencies is provided under item 8 of the <br /> I EAW. <br /> I This development proposal is subject to a myriad of ongoing public regulations which <br /> have been designed to mitigate the environmental effects of these types of projects. The <br /> project is required to comply with the Federal and State Clean Water Acts, including the <br /> I implementation of Best Management Practices for the construction activities on the site. <br /> The project is required to comply with the State Protected Waters and Wetland program <br /> enforced by the Department of Natural Resources. The project is required to comply with <br /> .. the rules and regulations of the Rice Creek Watershed District. The project is required to <br /> comply with the Comprehensive Plan, City Code, and Building and Fire Codes of the <br /> City of Arden Hills. Lastly, the City is requiring the project to comply with certain tree <br /> I and wetland protection measures as well as Shoreland Management and Floodplain <br /> regulations. The proposed conditions of approval for this PUD, as recommended by Staff <br /> and agreed to by the developer, would prohibit future modification to this development <br /> I proposal without further public input and City Council approval. <br /> 4. The extent to which the environmental effects can be anticipated and controlled as a <br /> I result of other environmental studies undertaken bv nublic a~encies or the proiect <br /> oroDoser. or ofEIS's previously prepared on similar j;>roiects , <br /> I The rules and regulations which apply to this development are based on well established <br /> practices by the reviewing agencies to prevent and mitigate the anticipated effects of the <br /> development activity. <br /> I The EA W, public agency comments on the EA W, and responses to those public <br /> comments have adequately identified the environmental effects which may be reasonably <br /> I expected to occur from this project.
