MEMORANDUM <br /> DATE: ,July 23,1997 <br /> I TO: Mayor and City Council <br /> I FROM: Brian Fritsinger, City Administra~ <br /> SUBJECT: 1997 Gateway Business District (GBD) Improvements - Fourteenth Street NE <br /> I Background <br /> I The City Council authorized the preparation of plans and spccifications for the Fourteenth Street <br /> Improvements at its June 30, 1997 meeting, Thc plans for this project have now been completed <br /> by Howard R, Green/MSA Consulting Engineers, and reviewed by City staff. <br /> I Staff has met with rcpresentatives of the Welsh Company and Vaughan properties to review the <br /> status of these propos cd improvements, Welsh has raised some concerns about the proposed <br /> I street elevations as it relatcs to the remainder of their project. They have inquired about the <br /> possibility of the strect bcing raised, Staffresponded that it had two concerns about this change, <br /> First is the impact on thc need for slope easements from the owner of the railroad property, <br /> --. Second is the effect on thc timing of the project if the City is required to revise plans, Welsh has <br /> not responded further to its request since this conversation, <br /> I The developer has also inquired as to the feasibility of undertaking the road and utility <br /> improvements as part of their site improvements, Staff has encouraged them to participate in the <br /> I formal bid process rather than agree to their undertaking the improvements as part of the <br /> development agreement. The City Attorney has not determined a simple method to preserve our <br /> right to assess this property if we were to allow them to complete the improvements, <br /> I One other question which was raised at the July 14, 1997 Council meeting was that of access to <br /> the Vaughan property, The City Attorney has indicated that the provision ofa twenty-foot (20') <br /> I access easement is adequate for meeting all legal requirements, He has suggested, however, that <br /> the City consider whether or not it may need a sixty foot (60') right,of-way in the long,term <br /> future, While this does not affect the current plans and specifications for the improvement road, <br /> I or the Welsh Company site plan, he advised the City to consider providing this additional right- <br /> of,way in the future if the City found the need for a sixty foot (60') right-of,way, <br /> I Recommendation <br /> Staff recommends that Council adopt Resolution No, 97-38, "Resolution Approving the Plans <br /> I and Specifications, Ordering the Improvement, and Ordering the Advertisement for Bids in the <br /> Matter of the Gateway Business District (GBD) Improvements - Fourteenth Street NE," <br /> t' BF IsIs <br /> I <br /> - <br />
