<br /> I' <br /> I CITY OF ARDEN HILLS <br /> I- MEMORANDUM <br /> DATE: July 28,1997 <br /> I '" <br /> TO: M.y" ..d C"y C"".dl', * <br /> I FROM: Kevin Ringwald, Community Development Directo v <br /> i <br /> " <br /> SUBJECT: Resolution 97-37, Transferring a portion of Hamline Avenue Service <br /> I Road to Bethel College (Quit Claim Deed) <br /> I Introduction <br /> The Staff requests that the City Council endorse Resolution 97-37 and authorize the City <br /> Attorney to file the attached Quit Claim Deed (Exhibit A), <br /> I Back~round <br /> The City Council on August 14, 1995 requested that the Staff pursue the release of certain right's <br /> I of way adjacent to State Highway 51 from the Minnesota Department of Transportation <br /> (MnDOT), at the request of Bethel College, The City Council on May 12,1997 received the <br /> Quit Claim Deeds from MnDOT and authorized that the deeds be recorded, The City now can <br /> Ie release, via Quit Claim Deed, the property to Bethel College, <br /> The City Attorney has reminded the Staff that the Planning Commission needs to review the <br /> I transfer of City lands, pursuant to City Code Section 20-24 (a), (2), unless the City Council finds <br /> that the transfer will not adversely impact the goals and policies of the City's Comprehensive <br /> I Plan and approves the request by at least four-fifths of the entire City Council (Exhibit B), The <br /> request was made as part of Planning Case 95-18 and was heard by the Planning Commission, <br /> However, they have not specifically looked at the Quit Claim Deed transferring the property, <br /> I Given, that the Planning Commission did hear this request as part of Planning Case 95-18, the <br /> City Council may wish to make a finding that the transfer of the road is not adversely impacting <br /> the goals and policies of the City's Comprehensive Plan, Otherwise, you may direct Staff to ' <br /> I place this action on the City Planning Commission's next available agenda (September 3, 1997), <br /> Budl!et Impact <br /> I None, except for the filing of the deed, <br /> Recommendation <br /> I The Staff recommends adoption of Resolution 97,37 and the authorization for the City Attorney <br /> to file the Quit Claim Deed with Ramsey County, <br /> I <br /> .. <br /> I <br />
