<br />I' t~A ~ <br /> V <br />I Fence located at 1509 Colleen Avenue <br /> LotI Block 2 McClung second addition <br />i' Written Statement <br />I As stated in my Administrative Appeal, dated June 12,1996, my fence has existedfor nine <br /> years without a complaint. The previous owners, John and Ester lv/cClung, had no objections <br /> to my fence and, in fact, complimented us on how nice it looked. <br />I On July 2,1996, the Planning Commission of Arden Hills UNANIMOUSLY apprOl'ed my <br /> Administrative Appeal by stating thefollowing: <br />I 1. The Applicant obtained a building permit for thefence and may not have been <br /> informed of the requirements for the construction of said fence; <br />I 2. The fence has been in place for at least nine years, without receiving a <br /> complaint, and when constructed the adjacent property was undeveloped; <br />I 3. The topography of the property to the east of the applicants has been recently <br /> altered, such that there currently exists a severe grade differential between the <br />I lots which may not al/ow for the necessary modifications to the fence; and <br /> 4. The fence has been wel/taken care of and complies with the remaining code <br />Ie requirements. <br /> A hardship would be created by destroying the existing landscaping, along the fence, which <br />I my wife has planted over the years and uses the fence as a support structure. The abutting <br /> property owners to the east have recently done landscaping along the fence which would be <br />I disturbed. By altering the fence, as suggested by the Building Official, would only degrade, <br /> not enhance, the appearance of it. <br />I Because of the landscaping to the abulling property on the east, of which most of the fence <br /> spans, there is a 5 foot grade differential for a large part of that span, which might be <br /> considered a safety hazard, should the fence be altered - see item 3 above. <br />I My wife has spoken with the neighbor of the abulling to the east several times since July 4th, <br /> 1996 and they have discussed ways to enhance the appearance on their side of the fence. <br />I Finally, Mrs. Liu, owner of the abutting property to the east, has stated they would be willing <br /> to come fonvard in support of my position. <br />I ! /1 :.' .-: Su!tt;{!({ 'oed o..r7!/{VJcYYl TD <br /> r /. / j::' ~ . /// <br /> /1 ... .I. 1.
