Pg. VI-4, Sec. VI, C, 2, a. Paris of Ihe Principal SlrUCllIre. Features which are part of a principal I
structure, including but not limited to eaves, cantilevered areas, cornices,
canopies, awnings, decks, balconies, steps, ramps, fire escapes and chimneys, I
may extend three (3) feet into the required front, side, and rear setbacks
but in no case shall the setback to these encroachments be less than five (5)
feet. I
Comment. The City Code in the Subdivision Ordinance (Chapter 22-8,
(0). (i)) states in relevam part that: "Easements at least ..
twelve (12) feet wide, cemered on rear and other lot lines,
shall he provided for utilities...". If parts of a principal
structure are allowed to encroach to within five feet of the
property line, then these structures would also encroach one I
(I) foot into the required six (6) foot utility and drainage
easement, Structures cannot encroach inro easements,
Suggestion. ParIS of the Principal SlrUClllre. Features which are part of a .
principal structure, inclnding but not limited to eaves,
cantilevered areas, cornices, canopies. awnings, decks,
balconies, steps, ramps, fire escapes and chinmeys, may I
extend three (3) feet into the required front, side, and r~ar
selbacks but in no case shall the setback to these
encroachments be less than ftve-t51 six (6) feet. I
Pg. VI-8, Sec. VI, E, 4, c.
Openness of Fences. All rences shall be at least thirty (30) percent open for
passage of light and air, except screening for mechanical equipment. I
Comment. The Zoning Ordinance allows for stone walls which do not
provide for 30 percem air flow, but does require fences to
provide for this requirement. The Staff does not understand I
the basis for this regulation and therefore requests its
deletion.
Suggestion. Delete Section VI, E, 4, c, of the Zoning Ordinance. I
