<br /> Under unusual circumstances, the Zoning Ordinance has a provision to altow dcviations from <br />. the fence regulation through the site plan review process. Section 6.EA.n of the Zoning <br /> Ordinance states: <br /> Deviations from [the] requirements for fences, walls, and landscape screening may be <br /> permitted after Planning COJnmission review and Council approval of a site plan with <br /> documentation showing the unusual circumstances justifying the proposed deviation <br /> and plans for the proposed fence, wall, or landscape screening. This provision is <br /> intcnded to allow flexibility in meeting the purpose and intent of this paragraph 4 <br /> without the necessity of providing a hardship as is rcquircd in the variance proccdurc. <br /> The objective of this provision is to improve the livability, appearance and security of <br /> properties and their relationships to one another. <br /> Additional Background Information: <br /> On May 3 I st, 2005, the City Council approved a requcst from thc applicant to vacatc the tcn <br /> foot wide pedestrian right-of-way that extended along the entire eastern side of 1104 Amble <br /> Drive. The City rctained the northern twenty feet and the eastern two feet of the pedestrian <br /> right-of-way. The proposed fence would extend into the vacated right-of-way that is now <br /> part of the applicant's property. <br /> There was a fence cxtending from the southeastern comer of the dwelling to the rear lot line; <br /> however, that fence was removed with the intent of constructing the larger fence proposed in <br />. this application. The old fence would have been considered a legal, non-confonning <br /> structure. <br /> 2.
