Enclosed is a draft of some recitals which I would suggest he I added to the proposed Sale and Purchase Agreement. The next City Council meeting is on September 29, 1997. This matter will be :reviewed at that time. I It is my legal opinion that the general and specific authority of the City Council as it relates to the development of property within the Gateway Business District enables the City to permit the Ie relocation of non-conforming uses, especially in those circumstances where the total amount of the non-conformity will be decreasing as a result of the relocation. I The Council has the specific authority to modify its sign regulations where essential to facilitate the purposes of the Gateway Business District. Given the preeent location of the I billboa;r;ds, it is essential that they be relocated both to acconunodate the current redevelopment project and any other meaningful redevelopment of adjacent areas.
