<br /> . <br /> Memorandum, Development Agreement with Welsh Development Company <br /> e Page Three <br /> September 19, 1997 <br /> Is the DevelQner Askin~ for the City to Incur any Additional Costs? <br /> The developer has requested that the City incur the cost related to the revised plans and <br /> specifications for Fourteenth Street improvements, The cost for these changes is estimated at <br /> $180,000, The changes are a result ofthe developer revising the site plan for development in <br /> order to reduce its cost for soil exporting, This issue is not directly identified in the current <br /> Development Agreement, The EDA needs to determine if this is acceptable, <br /> The second potential cost increase to the City is related to the changes in pond/wetland location, <br /> At the time of this report being prepared, the final design had not been completed, and no cost <br /> estimates prepared, The City and developer will need to resolve this issue, <br /> Recommendation <br /> The City Council is asked to approve the Development Agreement with Welsh Development <br /> Company, LLC substantially in the form presented subject to nonsubstantial changes being <br /> approved by the EDA's Development Attorney and City Administrator/Secretary; authorize the <br /> President and Secretary/Treasurer to execute all necessary documentation and approve the <br /> agreement subject to the following items: <br /> . The approval and execution ofthe Sale and Purchase Agreement between the City <br /> e of Arden Hills and Naegele Outdoor Advertising, Inc, <br /> . Clarification on the costs related to the Highway 96 improvements, <br /> . Determination ofthe wetland mitigation costs and agreement by the parties as to <br /> who is paying for these costs. <br /> . Completion of and compliance to all conditions identified on the approval of <br /> Planning Case #97-06. <br /> . Determination of the costs to the revised plans and specifications for Fourteenth <br /> Street improvements and agreement by both parties as to who is paying for these <br /> costs. <br /> . The developer providing the accurate legal descriptions necessary to complete the <br /> Development Agreement schedules, <br /> SF /sls <br /> M:IUSERSISHEILAIADMINIPLANNINGlGBDlDEV AGREE.MEM <br /> e <br /> -- -- <br />
