<br /> I <br /> I CITY OF ARDEN HILLS <br /> tt <br /> MEMORANDUM <br /> I DATE: December 8, 1997 <br /> TO: Mayor and City Council <br /> I FROM: Kevin Ringwald, Community Development Director~ <br /> I <br /> SUBJECT: Case #96-23, Extension of Approval <br /> Pilgrim House Unitarian Church, 1212 West Highway 96 <br /> I Request <br /> The applicant is requesting extension of their approval for a Special Use Permit (SUP) <br /> amendment to allow for the expansion of the Church (Exhibit A). <br /> I Back!!round <br /> The Planning Commission on December 4, 1996 recommended approval of Planning Case #96- <br /> I 23, Special Use Permit Amendment & Variances, subject to the following conditions: <br /> 1. Compliance with the letter from the City Engineer, dated November 21,1996; <br /> Ie 2. Approval by the Rice Creek Watershed District; <br /> 3. The smallest amount of bare ground is exposed for as short as time as feasible; <br /> 4. Temporary ground cover, such as mulch, is used and permanent ground cover, such as <br /> I sod, is established; <br /> 5. Methods to prevent erosion and trap sediments are employed; <br /> I 6. Fill is stabilized to accepted engineering standards, approved by the city engineer; <br /> 7. Provision of a landscape performance bond (125%); <br /> 8. Limitation of lighting to current levels and types; and <br /> I 9. Maintenance of opacity greater than 60 percent, per the landscape plan. <br /> The City Council on January 2, 1997 approved the Special Use Permit and Variances in Planning <br /> I Case 96-23 subject to the same conditions as the Planning Commission. <br /> The Zoning Ordinance in Section VIII, F, 2, states: .. Approval shall automatically expire and <br /> I become void one (1) year from the date on which the council granted such approval if the <br /> building permit or other approved improvements have not been issued a permit by the building <br /> I inspector. The council may extend the expiration date of such approval upon written application <br /> by the person to whom the approval was granted...". The applicant is not planning to pull a <br /> building permit until the Spring of 1998. Therefore, the approval granted in Planning Case 96-23 <br /> I would expire on January 2, 1998, unless the council extends the approval. <br /> Recommendation <br /> .- The Staff would recommend an extension of the approval of Planning Case 96-23 until January <br /> 2, 1999, based on that the applicant will be obtaining a building permit in the Spring of 1998. <br /> I <br />
