<br /> F. Other Setbacks - Meets requirements <br />. As noted above, the dwelling on Parcel A was demolished prior to submission of <br /> this application. A dwelling is under construction that would meet the required <br /> setbacks and impervious coverage requircments of the modified lot lines and <br /> sizes. The accessory structure, a garage, is still on the property. Like several <br /> other properties along Lake Johanna Blvd, the garage is within the front yard . <br /> setback and is a legal, non-conforming structure. <br /> The dwelling on Parcel B, which would remain, was approved with a variance <br /> under Planning Case 90- 1 5. The attached garage on the dwelling encroaches <br /> approximately ten feet into the frout yard setback from Sandccd Road. <br /> Additionally, the dwelling encroaches approximately two inches into the northern <br /> side setback and 1.6 feet into the southern side setback. <br /> 2. Subdivision Ordinance -iv/eets requirements with approved variance <br /> A. Zoning Ordinance. As noted above, Parcel A and Parcel B do not meet the <br /> minimum shoreline width requirement for lots on Lake Johanna. A variance is <br /> needed to approve a minor subdivision that results in two lots with shoreline <br /> widths less than the 85 foot requirement. <br /> B. Park Dedication. Since no new lots are being created, the park dedication fee <br /> would not apply. <br />. C. Existing Structures. The existing structure on the 3294 Lake Johanna Blvd <br /> property conforms was approved under Planning Case 90- 1 5 and conforms to the <br /> approved plans. <br /> A new dwelling is under construction on Parcel A. There is a remaining legal, <br /> non-conforming accessory structure on the property. <br /> Any new structures on either property would be required to meet all requirements <br /> of the R-2 Zone based on the new lot lincs and lot size. <br /> 3. Granting a Variance for a Subdivision <br /> Section 334.04 Subd. lO (Shoreland Management Ordinance) states that variances shall be <br /> processed in accordance with the procedures outlined in the Zoning Ordinance with the <br /> impractical standard being applied. <br /> A.
