However, sitc plan reviews are not public hearings and do not <br />require public notice. <br />Staff Recommendation <br />Based on thc submitted plans and findings of fact, Staff recommends approval of Planning Case <br />#06-022 for the Site Plan Review for the six foot high fence in the front yard. Staff recommends <br />the following sevcn conditions be included with the approval: <br />L The fence plans shall be modified so that the fence is no closer than twenty feet to thc lot <br /> line comer that is near the intersection of Lexington Avenue aJld Amble Drivc. Any <br /> significant changes to these plans, as determined by the City Planner, shall rcquire review <br /> and approval by the Planning Commission. <br />2. The applicant shall locate the utilities near the proposed fence before the fence permit is <br /> issued. The applicaJlt shall comply with any sctbacks set by the utility company, though . <br /> the fcnce shall not be moved any closer to Lexington A venue or Amble Drive than the <br /> modified plans. <br />3. The fence shall not encroach on the public right-of-way. The applicant shall be <br /> rcsponsible for locating the lot lines prior to the issuance of thc fcnce pemliL <br />4. Before the face of the fence is installed, the location ofthc posts shall be measured by thc <br /> City Planner to confirm that the posts are in conformance with the fence plans as <br /> modified by condition L The applicant shall be responsible for contacting the City <br /> PlaJmer prior to the installation of the face of the fence. <br />S. The applicant shall keep the fence maintained and promptly repaired if any damage <br /> occurs to the fence, including graiIiti. <br />6. The applicant shall maintain the vegetation on both sidcs of the fence. <br />7. The fencc shall not infringe on the lines of sight for Lexington Avenue and Amble Drive. <br /> The fcnce pennit shall be subject to approval by Ramsey County to ensure that the lincs <br /> of sight are protected.
