<br />. ~ <br />. ~HILLS <br /> MEMORANDUM <br /> DATE: August 30, 2006 PC Agenda Item 4.A <br /> TO: Planning Commission <br /> FROM: James Lehnhoff, City Planner <br /> SUBJECT: Clear-cutting Violation <br /> 34XX Lake Johanna Blvd <br /> As you are likely aware, a property on the western side of Lake Johanna was clear-cut at the end <br /> of July, which is in violation ofthe shoreland ordinance. The property does not have an assigned <br /> addrcss, but it is located immediately south of3441 Lake Johanna Blvd on the western side of <br /> Lake Johanna. Staff has been working with the property owner to resolve the situation to <br /> produce a positive outcome for the City and the neighborhood. While it is a regrettable situation, <br /> the propcrty owner has been very cooperative with the City. <br />. Mr. Ngo, the property owner, has volunteered to go through the Site Plan Review process to <br /> rcview the proposcd landscaping plan for the property. Generally, a residential property is not <br /> subject to a landscaping review. Staff has been working with Mr. Ngo to prepare a plan for the <br /> site. <br /> The official application will be submitted for the October Planning Commission meeting; <br /> however, Mr. Ngo and his contractor have submitted a draft plat to get some feedback before the <br /> plat is submitted for an offieial review. PI case review the background of the case and the <br /> attached draft materials. Mr. Ngo and/or his representative do plan on attending the meeting. <br /> Background: During the last part of July, the property owner of34XX Lake Johanna Blvd, Mr. <br /> Hien Ngo, hired a tree cutting service to remove the trees from his property to prepare the site for <br /> construction of a new home. Prior to the clearing, the property was vacant. The property owner <br /> claims that hc contacted the City to find out if a permit was needed to remove trees. The City <br /> does not require a permit for removing trees; therefore, it is quite possible that the property <br /> owner was told he did not need a permit. Unfortunately, it was not made clear that this is a <br /> property within the shore land overlay zone. Additionally, the tree cutting servicc also removed <br /> the trecs in the Ramsey County right-of-way for Lake Johanna Blvd and may have removed trees <br /> in the Fairview Avenue right-of-way, which is dedicated to the City. <br /> City of Arden Hills <br />.
