<br />>,. <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />~ <br />~HILLS <br /> <br />CITY OF ARDEN HILLS <br />Ramsey County, Minnesota <br /> <br />RESOLUTION No. 05-38 <br /> <br />A Resolution Vacating the City of Ardcn Hills' Interest in <br />A Pedestrian Way in the Karth Lake Hills Plat <br /> <br />WHEREAS, Len Gallus, resident of 1104 Amble Drive, Arden Hills, MN, has petitioned <br />the City of Arden Hills to vacate a Pedestrian Way which is adjacent to 1104 Amble Drive at <br />Lexington Avenue and is located within the City of Arden Hills; and <br /> <br />WHEREAS, on the 31 st day of May, 2005, a Public Hearing preceded by published, <br />posted, and mailed notice as required by Minn. Stat. 9412.851 was conducted before the Arden <br />Hills Council; and <br /> <br />WHEREAS, the Pedestrian Way currently contains the construction limits for <br />improvements to Lexington Avenue and a temporary easement to Ramsey County; <br /> <br />WHEREAS, the resident at 1104 Amble Drive has agreed to grant Ramsey County a no- <br />cost temporary easement for the construction limits during their improvements to Lexington <br />A venue; and <br /> <br />WHEREAS, at the conclusion of the Public Hearing, the Arden Hills Council <br />determined that retention ofthe Pedestrian Way no longer in the public's interest. <br /> <br />NOW, THEREFORE, BE IT RESOL YED that the Arden Hills Council hereby vacates <br />the City's interest in the following described Pedestrian Way: <br /> <br />1. That certain Pedestrian Way in Block 2 of the Karth Lake Hills plat dated the <br />14th day of October, 1977; Except the following portions: <br />a. The City retains ownership of the northerly 20 feet of the Pedestrian <br />Way for future improvements. <br />b. The City retains ownership of the easterly 2 feet of the entire length of <br />the Pedestrian Way (as a buffer to the new five-foot concrete sidewalk <br />to be constructed as part of the 2005 Lexington Avenue <br />improvements). <br />c. Granting of a temporary easement for a time period to be determined <br />by the Ramsey County Engineer and City notified in writing of such <br />time limit. <br /> <br />AND BE IT FURTHER RESOLVED, that such Pedestrian Way Vacation shall be <br />effective the day following publication in the Shoreview / Arden Hills Bulletin. <br />
