Draft Ordinance Language <br />February 9, 2026 <br />8.5 Parking Flexibility <br />The City may consider parking reductions of up to 25% for developments meeting <br />affordability requirements, provided adequate parking is demonstrated through a <br />parking study and subject to conditions ensuring affordable unit residents have <br />equitable access to parking at no additional charge. <br />9. AFFORDABLE HOUSING PLAN <br />9.1 Required Submission <br />All developments subject to this ordinance shall submit an Affordable Housing Plan as <br />part of the final development plan application. The plan shall be approved by the City <br />Council prior to issuance of building permits. <br />9.2 Plan Contents <br />The Affordable Housing Plan shall include: <br />a. Total number of units and number of affordable units by AMI level; <br />b. Unit mix showing bedroom counts for both market -rate and affordable units; <br />c. Site plan and floor plans showing location and distribution of affordable units; <br />d. Proposed rent levels for affordable units demonstrating compliance with <br />affordability limits; <br />e. Management plan describing marketing, tenant selection, income verification, <br />and annual reporting procedures; <br />f. Phasing plan showing proportional development of affordable and market -rate <br />units (if applicable); <br />g. Draft affordability covenant or deed restriction in form approved by the City <br />Attorney. <br />10. AFFORDABLE HOUSING AGREEMENT <br />10.1 Required Agreement <br />Prior to issuance of building permits, the developer shall execute an Affordable Housing <br />Performance Agreement with the City. The agreement shall incorporate the approved <br />Affordable Housing Plan and set forth all commitments and obligations of both parties. <br />10.2 Recorded Covenant <br />The developer shall execute and record with the County a covenant or deed restriction, <br />in form approved by the City Attorney, that runs with the land and ensures continued <br />affordability of designated units for the required period. The covenant shall be recorded <br />prior to issuance of certificates of occupancy. <br />10.3 Right of First Refusal <br />Page 6 of 8 <br />
