<br /> Plan Evaluation <br /> . 1. Applicable Driveway Regulations <br /> A. Driveway Access Points. Section 6.F.3.c.(6) ofthe Zoning Ordinance: <br /> Regulation: Access to streets. Each property which abuts one or more public streets, <br /> shall be entitled to at least one access to a public street. Single Family uses shall be <br /> Iimitcd to one (I) access per property. <br /> Proposal: The driveway would be permitted to rctain the two access points to Arden <br /> Place. The two access points are approximately fifteen feet apart (Section 6.F.3.c.(4) of <br /> the Zoning Ordinance requires residential driveways to bc separated by at least five feet). <br /> The Zoning Ordinance was amended in 2000 to prohibit new driveways with two access <br /> points to a public street (Ordinancc #322). While therc are a number of drivcways with <br /> two access points to a public street in the City, those driveways existcd prior to 2000 and <br /> are considercd to be legal, nonconforming uses. A legal, nonconforming use can be <br /> maintained and resurfaced, but it cannot be expanded. There are two other properties in <br /> the surrounding neighborhood with two access points. Those properties are 1545 Arden <br /> Place and 3581 Ridgcwood Road; however, those driveways pre-date the currcnt Zoning <br /> Ordinance and the second access points are permitted to remain. <br /> B. Improved surfaces. Section 6.F.J .c.(l) of the Zoning Ordinance: <br /> . Regulation: Surfacing. Off-street parking areas and driveways shall be improved with a <br /> paved surface. Such areas shall be so graded and drained so as to dispose of all surface <br /> water accumulation within the area as required by the City and the Rice Creek Watershed <br /> District. <br /> Proposal: The proposed driveway would remain as a crushcd rock surface, which is <br /> currently not in compliance with the Zoning Ordinance without an approved variance. <br /> The above regulation was also passed in 2000 (Ordinance #322). A paved surface <br /> typically includes asphalt, concrete, or pavers. While there are a number of unimproved <br /> driveways within the City, those driveways are considercd to be legal, nonconfonning <br /> uses because they existed prior to 2000. When these driveways arc reconfigured or <br /> expanded, a conforming driveway with an improved surface would be required unless a <br /> variance is granted. <br /> City of Arden Hills <br /> .
