26 <br />or grouping of information that includes Protected Health Information and <br />is maintained, collected, used or disseminated by or for Covered Entity. <br />J. Effective Date – means September 23, 2013, unless specifically noted <br />otherwise herein. <br />K. Electronic Health Record – means an electronic record of health-related <br />information regarding an Individual that is created, gathered, managed, <br />and consulted by authorized health care clinicians and their staff. <br />L. Electronic Protected Health Information – shall have the same <br />meaning as the term “electronic protected health information” in 45 C.F.R. <br />160.103, limited to the information created, received, maintained, or <br />transmitted by Business Associate from or on behalf of Covered Entity. <br />M. HITECH – means Health Information Technology for Economic and Clinical <br />Health Act. <br />N. HHS – means the United States Department of Health and Human Services. <br />O. Including – means “including but not limited to.” <br />P. Individual – shall have the same meaning as the term “individual” in 45 <br />C.F.R. Section 160.103 and shall include a person who qualifies as a <br />personal representative in accordance with 45 C.F.R. Section 164.502(g). <br />Q. Limited Data Set – shall have the same meaning as the term “limited data <br />set” in 45 C.F.R. Section 164.514(e)(2). <br />R. Privacy Rule – means the Standards and Privacy of Individually <br />Identifiable Health Information at 45 C.F.R. Part 160 and Part 164, subparts <br />A and E and the privacy provisions of HIPAA, as amended. <br />S. Protected Health Information – shall have the same meaning as the <br />term “protected health information” in 45 C.F.R. 160.103, limited to the <br />information created, received, maintained, or transmitted by Business <br />Associate from or on behalf of Covered Entity. Protected Health Information <br />specifically includes Electronic Protected Health Information and <br />Reproductive Health Protected Health Information. <br />T. Provider – means a hospital or professional practitioner duly certified or <br />licensed to provide health care services to Covered Individuals. <br />U. Reproductive Health Information – means anything related to the <br />reproductive systems and to its functions and processes as defined in 45. <br />CFR Section 160.103.
