5 <br />(a) That the Internet is not an error-free environment, Internet <br />access to the Website is not guaranteed by Benefit Extras to <br />be uninterrupted or error free, access to the Website is <br />subject to limitations, delays and problems inherent with the <br />Internet and electronic communications, and Benefit Extras <br />disclaims any and all warranties that the Website will meet <br />Employer’s requirements or that the Website will be <br />uninterrupted, timely, secure or error-free; <br />(b) That Benefit Extras shall not be liable for any loss, injury, <br />claim, liability, or damage of any kind resulting in any way <br />from: (1) any errors in or omissions from the Website; (2) the <br />unavailability or interruption of the Website or any features <br />thereof; (3) Employer’s use of the Website; (4) the loss or <br />corruption of any data or equipment in connection with the <br />Website; (5) any content retrieved from the Internet even if <br />retrieved or linked to from within the Website; or (6) any <br />content or information retrieved or accessed as a result of <br />Employer utilizing any third party links made available on the <br />Website. <br />5. The parties shall use reasonable efforts to take precautions against <br />the contamination of their respective systems and computer files <br />with software viruses, worms or other malicious agents that may <br />reside within files transmitted through the Website. At a minimum, <br />such precautions shall include the installation, upgrading and use of <br />commercial virus detection software to scan files and documents <br />transmitted via the Website. Additionally, the parties shall use <br />reasonable efforts to identify and to correct or remove any document <br />or file that may have infected data or contain viruses or other <br />malicious agents. Benefit Extras reserves the right to delete infected <br />documents, files or programs, and Benefit Extras shall have no <br />liability to Employer, or the sender or intended recipient of infected <br />materials for such action. However, no precautions or virus detection <br />software is or can be effective against all viruses, and the parties <br />shall have no liability with regard to any contamination of files, <br />documents, or the Website. <br />F. Recordkeeping. Benefit Extras shall keep all Plan records related to the <br />Administrative Services, including records of: <br />1. all Qualifying Events of which it is notified; <br />2. all notices sent and received by it regarding Continuation Coverage; <br />3. any acceptance or rejection of Continuation Coverage;
