[275.084] [TRANSPORTATION UTILITY FEE.] <br />Subdivision 1. [DEFINITIONS. ] For the purposes of this <br />section, t~~ followinq terms have the meaninqs qiven~. <br />(1) !lMunicipality" means a home rule charter or statutory <br /><:.i!Y.- <br />(2) 'lGoverning_~bodyll means the city council of a <br />munJcipality. <br />ilL "Reconstruction 11 means p_~:-!_inq, qradinq, curbs and <br />gutters 1.. bridqe repair, overlays 1 d~ai-n;~ge, base work, subqrade <br />corrections, a~d boulevard restoration. <br />(4) IIFacility upgradell means traffic siqnals, turn lanes, <br />media~s, street approaches!_ alleys, rights-of-way, sidewalks, <br />retaining wa.~ls, fence installation, and additi~~~l traffic <br />lanes. <br />(5) "Maintenance"_^"f!\eans striping / seal coatinq, crack <br />s~aling, sidewalk m~tntenance, signal maintenance, street ligh~ <br />maint~nance, and siqnage. <br />Subd. 2. [AUTHORIZATION.] A municipality may impose the <br />transpo!tation utility fee p!9vided in this section against land <br />located within its boundaries. <br />Subd. 3. [PROCEDURES FOR ADOPTION.] A municipality may <br />impose the transportat~~n utility fee provided in this section <br />by ordi~ance adopted by a two~thirds vote of its governing <br />body. The re~qlution must not be voted on S?~._~dopted until <br />aft~r a public hearing. has been held on the question. A noti~~ <br />of th~ time, place, and p~rpose of the hearing must be published <br />at least once in each week for two successive weeks in the <br />9fficial newspap~.:r:. _of the municipality, or in a newspap'~_J:'_ .9f <br />qener~l content and circula.tion within the municipality, and the <br />last notice must be published at_ least seven days prior to the <br />hearing. T_he municipality, if adS?pt_~si_,.___must file the ordinance <br />of record with th~.__~ounty recorder, and the municipa~Ll;:y__must <br />provi?e a copy to the cou~ty auditor. <br />Subd. 4.
