<br />. <br /> <br />. <br /> <br />. <br /> <br />~ <br />~~HlLLS <br /> <br />CITY OF ARDEN HILLS <br />RAMSEY COUNTY, MINNESOTA <br /> <br />CITY OF ARDEN HILLS <br />RESOLUTION NO. 03-55 <br /> <br />RESOLUTION APPROVING LAKE IMPROVEMENT DISTRICT <br />CRITERIA FOR KARTH LAKE AND <br />ESTABLISIDNG A DATE FOR A PUBLIC HEARING <br /> <br />WHEREAS, pursuant to Minnesota Statutes 459.20 and Minnesota Statutes 103B. 501- <br />103B.581, the City of Arden Hills has the authority to establish and administer a Lake <br />Improvement District for lakes located wholly within its boundaries; <br /> <br />WHEREAS, Karth Lake is located wholly within the boundaries of the City of Arden <br /> <br />Hills; <br /> <br />WHEREAS, the consulting engineer for the City of Arden Hills has prepared a report <br />(Engineering Study) dated the 20'h day of August 2003, which describes a necessity of <br />constructing and monitoring a lake elevation control structure for Karth Lake and which is <br />attached hereto as Exhibit A; and <br /> <br />WHEREAS, pursuant to Minnesota Statutes 103B.501-103B.581 in Minnesota rules <br />6115.0900-6115.0980 the City of Arden Hills has prepared a proposed order establishing and <br />providing for the administration of the Karth Lake Improvement District for the purpose of <br />constructing and monitoring a lake elevation control structure. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Arden Hills City Council: <br /> <br />I. The Engineering Study is approved. <br /> <br />2. The boundaries of the proposed Karth Lake Improvement District as illustrated <br />and described in the Engineering Study are temporarily approved subject to final <br />approval following the public hearing. <br /> <br />3. The City of Arden Hills intends to establish the Karth Lake Improvement District <br />as proposed in the Engineering Study. <br /> <br />4. The public hearing to accept comments regarding the establishment of the Karth <br />Lake Improvement District shall be held at 7.00 p.m. on the 29th day of <br />September, 2003 at the Arden Hills City Hall, 1245 west Highway 96, Arden <br />Hills,MN. <br /> <br />5. <br /> <br />Consulting Engineer for the City of Arden Hills shall provide the Commissioner <br />of the Department of Natural Resources and the Minnesota Pollution Control <br />Agency a certified copy of this resolution and the document of criteria for the <br />Lake Improvement District for Karth Lake at least 40 days prior to said public <br />hearing. <br />
