ARDEN HILLS CITY COUNCIL—NOVEMBER 27, 2006 4 <br /> • Mr. Ngo stated he would not have any problem with moving the trees and he believed he <br /> probably should move the trees. <br /> Mr. Gonzalez stated he lived next door to this property and he asked what would he be allowed <br /> to do when he upgraded his home next year. He noted large trees were being replaced with <br /> smaller ones, which interfered with his view and not the Ngo's view. He noted there was an <br /> illegal act done and nothing was done to address it. He believed this action devalued his <br /> property. Mayor Aplikowski asked why would this stop Mr. Gonzalez from doing what he <br /> wanted to do with his yard. <br /> Mr. Gonzalez stated the trees removed were shade trees and that affected his property. He stated <br /> the applicant was getting what they wanted. Mayor Aplikowski stated the applicant had been <br /> working with the City on this. <br /> MOTION: Councilmember Larson moved and Mayor Aplikowski seconded a motion <br /> to add one additional condition to provide for the movement of some of <br /> the larger trees towards the center of the property both down on the lake <br /> and on the land between Lake Johanna Boulevard and the home subject to <br /> staffs approval. <br /> Councilmember Holden asked how far to the center of the property was Councilmember Larson <br /> 1111 recommending. Councilmember Larson responded he believed staff could determine where the <br /> trees are to be placed and staff understood Council's direction. <br /> The motion carried unanimously(5-0). <br /> MOTION: Councilmember Larson moved and Councilmember Pellegin seconded a <br /> motion to approve the Planning Case 06-028: Site Plan Review for Hien <br /> Ngo and Nguyet Ky, 3433 Lake Johanna Boulevard subject to the 12 <br /> conditions. The motion carried(4-1) (Councilmember Holden opposed.) <br /> C. Motion to Authorize City Staff to Apply for a Grant through the Safe Routes to <br /> School with the Minnesota Department of Transportation <br /> Ms. Olson stated the Minnesota Department of Transportation has recently announced its 2007 <br /> Safe Routes to School (SRTS) Grant Program. The trail segments that County and City staff has <br /> tentatively selected for this grant are in the Valentine Hills Elementary School area. She noted <br /> the Parks, Trails and Recreation Committee recommended approval. <br /> Councilmember Holden asked if this grant would pay for engineering costs also. Ms. Olson <br /> responded that was correct. <br /> Councilmember Holden asked if they could apply this to the high school also. Ms. Olson <br /> responded the grant was for K-8 only at this time. <br />
