<br /> . <br /> e CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> DATE: January 5,1998 <br /> TO: Mayor and City Council <br /> FROM: Kevin Ringwald, Community Development Director~ <br /> SUBJECT: Resolution 98-08, Vacating a portion of the 14th Street Northeast <br /> right-of-way (legal description modification to Resolution #97-55) <br /> Introduction <br /> The Staff requests that the City Council endorse Resolution 98-08 modifying the legal <br /> description (previously approved in Resolution #97-55) which vacates a portion of the 14th <br /> Street Northeast right-of-way (Exhibit A). <br /> Background <br /> The City Council on November 10,1997 approved Resolution #97-55 which vacated a part of <br /> the 14th Street right-ot~way in the Gateway Business District. The vacation facilitates the <br /> . development approved in Planning Case 97-06 (Welsh - Phases II, III, and IV). The County <br /> Surveyor is requiring that the legal description of the vacation relate to the original plat <br /> (Butcher's Allotment No.1) from which it was dedicated. The legal description has been <br /> modified so that it relates to said plat. <br /> Recommendation <br /> The Staffrecommends adoption of Resolution 98-08, modifying the legal description of the <br /> vacated portion of the 14th Street Northeast right-of-way, subject to this resolution being <br /> consecutively filed with the recording of the Plat of Gateway Addition (as approved in Planning <br /> Case 97-06) and the ownership ofthe replacement right-of-way (Gateway Boulevard) being <br /> transferred to the City. <br /> . <br />
