The prevailing party in any action or proceeding <br /> brought to enforce this Lease shall be entitled to . <br /> recover its reasonable attorney's fees, costs, and <br /> expenses in connection with such action or <br /> proceeding from the other party. <br /> j . The parties agree to execute a Memorandum of Lease <br /> and\or a Memorandum of Commencement hereof in form <br /> appropriate for recording in the county in which <br /> the Property is situated. <br /> k. Tenant shall be responsible to Landlord for <br /> damages to or additional maintenance of the water <br /> tower resulting from the installation of the <br /> antenna facilities including but not limited to <br /> repainting of areas which are welded, cut or <br /> drilled as part of the installation; Tenant shall <br /> be responsible to Landlord for additional <br /> maintenance or repair costs incurred by Landlord <br /> due to the presence of the antenna facilities on <br /> the water tower; and Tenant shall be responsible <br /> M~~ for restoration of the water tower from damage, if <br /> ~ ff'- any~Tenant's antenna facilities are removed from . <br /> ~ ~ the water tower and/or replaced by other such <br /> .r facilities belonging to the Tenant. Tenant will <br /> take its own measures to protect its own equipment <br /> when Landlord makes repairs or does maintenance on <br /> the watertower. These measures may include but <br /> are not limited to having tower technicians on <br /> site to take down and re-install or relocate <br /> Tenant equipment that might be damaged during <br /> maintenance or painting. Landlord agrees to give <br /> at least thirty (30) days written notice of any <br /> such activities to Tenant and to reasonably <br /> cooperate with Tenant to carry out such activities <br /> with a minimum amount of interference with <br /> Tenant's transmission operations. <br /> 16 . <br /> . <br />
