CITY OF ARDEN HILLS <br /> MEMORANDUM <br /> DATE: June 10, 1998 <br /> TO: Brian Fritsinger, City Administrator <br /> ~ <br /> FROM: Dwayne Stafford, Public Works Director <br /> SUBJECT: Lake Josephine Ordinance and Joint Powers Agreement <br /> Background <br /> The City of Arden Hills Public Safety Commission was presented with a request for help in <br /> the development of an ordinance pertaining to surface water use on Lake Josephine at their <br /> May, 1997 meeting. Mr. William Costello, Director of the Lake Josephine Improvement <br /> Association, indicated increased boating traffic and the manner in which some watercraft <br /> are being operated, has become a serious concern for those residing on the Lake, as well as <br /> those using the Lake. <br /> . At that time, Roseville and Shoreview Staff were working on an ordinance specification for <br /> Lake Owasso. Public Safety Commission members agreed with Roseville Staffto wait <br /> until the Owasso ordinance was finalized and use that ordinance as a model for the Lake <br /> Josephine Ordinance. Public Safety Commission Chairman Tholen stressed the importance <br /> of keeping lake ordinances as unifornl as possible for enforcement reasons. <br /> Following several meetings with Lake Josephine Improvement Association officers and <br /> many conversations with Mr. Steve North, Roseville Assistant City Manager, a Joint <br /> Powers Agreement and Ordinance were drafted specifically for Lake Josephine. <br /> Attorneys for both Cities and the Arden Hills Public Safety Commission have approved the <br /> Ordinance and the Joint Powers Agreement in their present form. <br /> Mr. North has provided copies of the proposed Joint Powers Agreement and Ordinance to a <br /> Department of Natural Resources (DNR) official, who felt both documents would be <br /> approved at the appropriate time. <br /> Process <br /> If Council approves the Ordinance and Joint Powers Agreement in its present state, it <br /> would be appropriate to hold a public hearing on this issue and invite all property owners <br /> on the Arden Hills portion of the Lake to attend. Staff would provide mailed and <br /> . newspaper notices of this hearing. <br />
