MEMORANDUM <br /> DATE: February 9, 1998 <br /> TO: Mayor and City Council <br /> FROM: Kevin Ringwald, Community Development Director ~ <br /> SUBJECT: Casc #97-06, PUD (modification of condition #1) <br /> Welsh Companies, 4000 Round Lake Road <br /> ReDuest <br /> The applicant is requesting approval of a modification to condition # 1 (No issuance of occupancy <br /> permits for that part of the project (Phases II, III, and IV) greater than 200,000 square feet until <br /> such time that the relocated Round Lake Road is open for traffic and capable of accepting <br /> increased traffic) in Plmming Case 97-06 which facilitated the development of Phases II, III, and <br /> IV of the Gateway Business District (Exhibit A). <br /> Back!!round <br /> The Planning Commission on July 2, 1997, recommended approval of the PUD Master Plan and <br /> plat in Planning Case 97-06. The City Council on September 22, 1997, approved the PUD <br /> . Master Plan and plat in Planning Case 97-06. <br /> As you may remember, Planning Case 97-06 consisted of a three building proposal in the <br /> Gateway Business District, which carried on the construction which occurred as part of Planning <br /> Case 96-12 (Phase 1,155,000 square feet). Phase II is 104,532 square feet, Phase III is 115,575 <br /> square feet, and Phase IV (initial) is 72,000 square feet with 30,000 square feet of expansion. <br /> Welsh Companies' traffic engineer (Benshoof and Associates) conducted a traffic analysis to <br /> determine how much capacity was left in the intersection of Round Lake Road and Highway 96 <br /> after the Phase I (155,000 square feet) building was built. In short, how much square footage of <br /> building can be built and occupied in the GBD before the realignment and signalization of the <br /> Round Lake Road and Highway 96 intersection is required. To which Welsh Companies traffic <br /> engineer responded, that up to 200,000 square feet of development could be constructed before <br /> said improvements are required (Exhibit B). Therefore, the City Council placed the following as <br /> condition #1 on the PUD approval: "No issuance of occupancy permits for that part of the project <br /> (Phases II, III, and IV) greater than 200,000 square feet until such time that the relocated Round <br /> Lake Road is open for traffic and capable of accepting increased traffic." <br /> The City in January of 1998 was informed by Welsh Companies (Dick Zehring) that AmberJack <br /> (the real estate arm of State Farm Insurance and owners of Phase I) wished not only to purchase <br /> and build Phase II, but also Phase III in the GBD. Additionally, they wished to start construction <br /> of both buildings in March of 1998. <br /> . <br /> \.J <br />
