<br /> the State of Minnesota, or the United States Government. The term "Hazardous Material"
<br /> includes, without limitation, petroleum products, asbestos, PCBs, and any material or substance
<br /> that is (i) defined as a "hazardous waste" pursuant to Section t 004 of the Federal Resource .
<br /> Conservation and Recovery Act, 42 U.S.c. 6901 et seq, (42 U,S,C, 6903), or (ii) defined as a
<br /> "hazardous substancelt pursuant to Section 101 of the Comprehensive Environmental Response,
<br /> Compensation and Liability Act, 42 U,S.c. 9601 et seq, (42 U.S.c. 9601). As used herein, tbe
<br /> tem\ "Hazardous Material Law" shall mean any statute, law, ordinance, or regulation of any
<br /> governmental body or agency (including the U.S. Environmental Protection Agency, the
<br /> Minnesota Pollution Control Agency, and the Minnesota Department of Health) which regulates
<br /> the use, storage, release, handling, transportation, generation, treatment, or disposal of any
<br /> llazanlous Material.
<br /> 46. Exculpation, If Lessor is a corporation, trust, partnership, joint venture, unincorporated
<br /> association, or other form of business entity: (i) the obligations of Lessor shall not constitute
<br /> personal obligations of the officers, directors, trustees, partners, joint ventures, members, owners,
<br /> stockholders, or other principals or representatives of such business entity; and (ii) Lessee shall
<br /> not have recourse to the assets of such officers, directors, trustees, partners, joint ventures,
<br /> members, owners, stockholders, principals, or representatives except to the extent of their interest
<br /> in the [ndustrial Center. Lessee shall have recourse only to the interest of Lessor in the Industrial
<br /> Center for the satisfaction of the obligations of Lessor and shall not have recourse to any other
<br /> assets of Lessor for the satisfaction of such obligations.
<br /> 47. Addendum. Attached hereto is an addendum containing paragraphs 1 through 9 which
<br /> constitute a part of this Lease.
<br /> LESSOR AND LESSEE HAVE CAREFULLY READ AND REVIEWED THIS LEASE AND
<br /> EACH TERM AND PROVISION CONTAINED HEREIN AND. BY EXECUTION OF THIS
<br /> LEASE. SHOW THEIR INFORMED AND VOLUNTARY CONSENT THERETO. THE
<br /> PARTIES HEREBY AGREE THAT. AT THE TIME THIS LEASE IS EXECUTED, THE
<br /> TERMS OF THIS LEASE ARE COMMERCIALLY REASONABLE AND EFFECTUATE
<br /> THE INTENT AND PURPOSE OF LESSOR AND LESSEE WITH RESPECT TO THE
<br /> PREMISES.
