He explained the lot split only accommodates ownership and not a site use. <br /> Mr. Ringwald advised the Planning Commission recommends approval of Planning Case 98-13, <br /> zero lot line lot split and variances (lot width and depth), based on the "Findings-Lot Width <br /> Variance (northerly parcel)" and the "Findings-Lot Depth Variance (southerly parcel)" sections <br /> of the Staff report dated May 6, 1998, conditioned upon recording of a party wall agreement in a <br /> form acceptable to the City Attorney. <br /> Mr. Ringwald noted that the applicant has provided the party wall agreement for review and <br /> approval by the City Attorney. The City Attorney has reviewed and approved of its substance <br /> and form. <br /> Councilmember Malone noted the Planning Commission indicated concern regarding exterior <br /> coordination which was to be addressed in the party wall agreement. <br /> Marlyn Tramm, 3180-3182 Cleveland Avenue, applicant, noted this issue is addressed in <br /> Section 2 of the party wall agreement. <br /> MOTION: Councilmember Hicks moved and Councilmember Malone seconded a motion to <br />. approve Planning Case #98-13 for a zero lot line lot split and variances requested <br /> by Marlyn Tramm for 3180-3182 Cleveland Avenue, based on the "Findings-Lot <br /> Width Variance (northerly parcel)" and the "Findings-Lot Depth Variance <br /> (southerly parcel)" sections of the Staffreport dated May 6, 1998, conditioned <br /> upon recording of a party wall agreement in a form acceptable to the City <br /> Attorney. The motion carried unanimously (5-0). <br /> 3. Planning Case #98-14, Ann Sturgeon, 3769 New Brighton Road, Lot Split <br /> Mr. Ringwald advised that the applicant has withdrawn this application via a written request. <br /> 4. Planning Case #98-15, McGuire's Sign-A-Rama, 1201 West County Road E, <br /> Special Use Pcrmit <br /> Mr. Ringwald explained the applicant is requesting approval of a Special Use Permit (signage) <br /> modification (Planning Case #95-6) for the Holiday Inn/McGuire's, 1201 West County Road E, <br /> to allow for the placement of four neon stripes adjacent to the existing McGuire's sign (wall) <br /> facing County Road E. He noted they have a 12 square foot sign identifying the restaurant and <br /> the applicant would like to place two neon stripes on either side to accent the exterior. <br /> Mr. Ringwald advised that the Planning Commission recommends approval of Planning Case <br /> #98-15, Special Use Permit (signage), subject to compliance with the plans in Exhibit A of the <br />. Staff memorandum dated May 5, 1998. <br />
