<br /> - <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY . <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 98-44 <br /> A RESOLUTION AUTHORIZING CONDEMNATION <br /> OF THE INDYKIEWICZ PROPERTY <br />WHEREAS, the City of Arden Hills is in the process of planning and constructing the Round <br />Lake Road Intersection Improvement Project ("Project"); and <br />WHEREAS, George and Eleanor lndykiewicz are the record fee owners of the property <br />described on Exhibit A attached ("Indykiewicz Property"); and <br />WHEREAS, in order to construct the Project, the City will need to acquire all or a major portion <br />of the lndykiewicz Property; and <br />\VHEREAS, negotiations to acquire all or a portion of the lndykiewicz Property have, to date, <br />been unsuccessful. <br />NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of Arden Hills, <br />Minnesota: e <br />That the Arden Hills City Attorney is hereby authorized to commence a condemnation <br />proceeding to acquire all or that portion of the Indykiewicz Property which is necessary in <br />order to construct the Project; and <br />BE IT FURTHER RESOLVED by the City Council of the City of Arden Hills, Minnesota: <br />That the City Attorney is hereby directed to continue to use all reasonable efforts to <br />acquire such property through negotiations provided that the negotiations do not <br />unreasonably delay the construction of the Project. <br />PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF ARDEN HILLS <br />THIS 8TH DAY OF JUNE, 1998. <br /> DENNIS PROBST, MAYOR <br />A TrEST: <br />BRIAN FRITSINGER, CITY ADMINISTRATOR <br /> . <br />
