MEMORANDUM <br /> DATE: July 28,1998 <br /> TO: Mayor & City Council <br /> FROM: Dave Scherbel, Building Official :f) 2 <br /> SUBJECT: Resolution #98-51, Request for Commencement of Abatement at 3171 <br /> & 3183 North Lexington Avenue <br /> Request <br /> The Staff requests that the City Council adopt Resolution #98-51. Resolution #98-51 would <br /> make several findings in regard to the "Hazardous Building" conditions located at 3171 & 3183 <br /> North Lexington Avenue, and to authorize commencement of the abatement proceedings under <br /> Minnesota Statutes 463.15, Et seq relative to 3171 & 3183 North Lexington Avenue. <br /> Background <br /> The following is a brief history ofthe City's Code enforcement activities on 3171 & 3183 North <br />. Lexington Avenue. <br /> An on-site inspection of the property revealed that the homes are in an unsafe condition and <br /> threaten the safety of the surrounding community. Because of the dangerous conditions present, <br /> the homes should be removed as soon as possible. <br /> The City had sent the property owner, Mr. Tony Andersen, letters on April 20, 1990 and August <br /> 25, 1991, informing him ofthe hazardous conditions that existed at 3171 & 3183 North <br /> Lexington Avenue. The letters gave Mr. Andersen 30 days to remove all code violations. There <br /> is no recorded response. The City also sent letters on February 25,1998, March 25,1998, May <br /> 12,1998 and June 4, 1998, All ofthe letters informed Mr. Andersen of the numerous code <br /> violations, and dangerous conditions that existed at 3171 & 3183 N. Lexington, Mr. Andersen <br /> responded twice by letter and once in person and agreed the homes were in poor condition and <br /> they should be removed as soon as possible. <br /> The City did not receive a firm date for the removal of the homes. Therefore, on July 6, 1998, <br /> the City sent a letter to Mr. Andersen informing him that the homes needed to be removed no <br /> later than August 15, 1998, Ifhe did not remove the buildings, the City would begin legal <br /> proceedings for the demolition of all buildings located at 3171 & 3183 N. Lexington, with all <br /> costs, including legal and staff fees incurred during the process, assessed to the property. <br /> Enclosed are copies of all correspondence (Exhibit A) to Mr. Andersen from the City and letters <br />. in response from Mr. Andersen (Exhibit B). Also included are photographs taken of the property <br /> earlier this year (Exhibit C). <br />
