Mayor Probst noted the suggestion that Mr. Zehring, the Welsh Companies, may be back and suggested that only happen ifhe improve things on this own and not seek additional funds. Mr. Fritsinger explained that the last conversation with Mr, Zehring and his attorney was that the significant issue is the City has withheld the certificate of occupancy until the aesthetic issues comply with what the Council rcviewed and approved. The problem from their perspective is that this is an $18 million project slated for closing today and tomorrow and the legal issues of withholding an certificate of occupancy for aesthetic issues is not well received by the attorneys. It was noted that Mr. Ringwald talked with Mr. Zehring and Mr. Hart about how to resolve some of these items. One of the difficult issues is that the fourth building does not match the third building aesthetically. The fourth building is in the process of being sold and will then be privately owned. Because of that the architect made some minor changes, such as having the green strip which is the corporate color. The City, in reviewing the building plans, had requested review of the color schemes, On that issue there was reference in the building plans about the building color and it was thought to be the sanle color as the building next door and approved under that impression. Mr, Fritsinger reported that discussion occurred about that issue and that this was not "flagged" on the plans to draw attention to it. They agreed to repaint that stripe to match building three and to add a band, and the coping will be investigated to see if it can be painted to match the greens. The replacement of the windows and coping is too expensive. . Mr. Fritsinger stated that Mr. Zehring indicated he will provide a response by the end of next month. Councilmember Malone stated that the PMS color system is used by a printer, not a paint manufacturer, and is an invalid argument Councilmember Larson stated that he remembers a discussion with the Planning Commission about how the building would look and their indicating the buildings would be a mirror image of each other. Mr. Fritsinger explained their argument is that the buildings are still a mirror image and the color difference is insignificant and would not be noticed by anyone. ADJOURN MOTION: Councilmember Keirn moved and Councilmember Aplikowski seconded a motion to adjourn the meeting at 10:42 p.m, The motion carried unanimously (5-0), .
