CITY OF ARDEN HILLS <br /> . <br /> MEMORANDUM <br /> DATE: November 30,1998 <br /> TO: Mayor and City Council <br /> FROM: Kevin Ringwald, Assistant to the City Administrator <br /> SUBJECT: Case #98-17, Minor Subdivision - Extension of Approval <br /> John McClun2, 4236 Snellin2 Avenue <br /> Reauest <br /> The applicant is requesting that the approval granted by the City Council in Planning Case 98-17 <br /> be extended an additional 60 days to allow sufficient time to record the easement vacation and <br /> the necessary deeds (Exhibit A). <br /> Backl!round <br /> The Planning Commission at its July I, 1998, regular meeting recommended approval of this <br /> Planning Case with several conditions, The City Council at its August 31, 1998, regular meeting <br /> approved the request with the following conditions: <br />. L Payment of the appropriate park dedication fee, <br /> 2, Provision of calculations, in a form acceptable to the City Engineer, determining the <br /> appropriate size of the replacement area for the easement area which is to be vacated. <br /> 3, Provision of drainage and utility easement in a form acceptable to the City Attorney. <br /> 4, Informing the buyer(s) of Parcel A and B, by the applicant, of the restrictions imposed by <br /> the drainage easement in potential building expansion or deck construction. <br /> 5, Recording the subdivision in the form of a Registered Land Survey. <br /> 6, Provision of the necessary drainage and utility easements along the property lines, as <br /> required by the City Code, in a form acceptable for filing with Ramsey County, <br /> 7, Payment of the park dedication fee shall occur prior to recording of the minor <br /> subdivision, <br /> 8, The lowest floor elevation for Lots A and B shall be at an elevation no lower than 917.63. <br /> 9. Recording ofthe drainage and utility easement, in a form acceptable to the City Attorney, <br /> prior to the recording of the minor subdivision, <br /> 10, Provision ofponding such that the drainage and utility easement required for the pond on <br /> Lot B can be reduced to the existing utility and drainage easement and such work shall be <br /> completed before any building permits will be issued for Lots A, B, or C. <br /> The City Code (Subdivision Ordinance) in Section 22-4, (b), (4), states that; "If the final plat is <br /> approved by the City Council, the subdivider shall record it with the county recorder or registrar J <br /> of titles within sixty (60) days after the date of approval; or otherwise, the approval of the final <br /> plat shall be considered void ..,". Given that the City Council approved the final plat on Monday, <br />. August 31,1998, then the final plat would have to been recorded by Friday, October 30,1998. <br />
