<br />. <br /> <br />CITY OF ARDEN HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />April 6, 2001 <br /> <br />FROM: <br /> <br />Mayor and City Council <br /> <br />Jennifer Chaput, City Planner~ <br /> <br />Planning Case #01-09 Final PlatlVacation of Easement <br />Chesapeake Companies, NE Quadrant ofI-694 and I-35W <br /> <br />TO: <br /> <br />SUBJECT: <br /> <br />ReQuest <br />The applicant is requesting a final plat of the Morris Communications property, located in <br />the Northeast quadrant ofI-694 and I-35W, <br /> <br />. <br /> <br />Backl!round <br />The City Council approved the preliminary plat of the Morris Communications property <br />in January, 2001. The preliminary plat met all of the requirements of the City Code and <br />created one developable lot (which is actually, by plat, three Jots due to the railway <br />intersection and the road easement) and two outlots for the existing billboards, Following <br />approval of a preliminary plat, the applicant had three months to file a final plat <br />application with the City, The purpose of the final plat application is to incorporate any <br />changes that the City Council required during the preliminary plat phase, There were no <br />changes required at that time so this is just a procedural application. <br /> <br />As a part of the final plat application, a vacation of easements application has been made <br />as well. The Morris Communications property has two road easements (3fd Avenue and <br />13th Street) in favor of the City of Arden Hills at this time, In order to file for final plat, <br />the State Statutes requires that the easements be vacated by the City and be dedicated <br />back to the City, Submitted as part of the application are copies of easement documents <br />1688078,1719279, 1832660, and 2110427. <br /> <br />The City Council is required by State Statute to hold a public hearing to vacate and <br />dedicate the easements, Attached is Resolution #01-11, outlining the findings for this <br />procedure, as required by the State of Minnesota Chapter 412,851, vacation of streets, <br /> <br />The City Council received all information pertinent to this case as part of the Planning <br />Commission packet for the April 4 Planning Commission meeting, <br /> <br />. <br /> <br />Deadline for Al!encv Actions <br />The City of Arden Hills received the complete application for this request on March 7, <br />2001. Pursuant to Minnesota State Statue the City must act on this request by May 6,2001 <br />
