<br />. <br /> <br />. <br /> <br />. <br /> <br />RECEI'ji~D <br /> <br />SECOND AMENDMENT <br />TO RAMSEY COUNTY HOUSING AND REDEVELOPMENT AUTHORITY Mi\ Y 0 8 2000 <br />JOINT COOPERA nON AGREEMEMNT <br /> <br />C'~\t n- <br />'Il, ' I.. !"" <br />VI "J'';L./ ~.:; <br /> <br />HilLS <br /> <br />/I The Joint Cooperati n Agreement between the County of Ramsey and <br />C. ~ ("MUNICIPALITY") commencing August 31, 1991, <br />and the irst Amendment to that Agreement, effective July I, 1997, (collectively <br />"AGREEMENT") is further amended as follows: <br /> <br />L The effective date of this Second Amendment is July 1,2000. <br /> <br />2. The AGREEMENT is amended by the addition of the following language: <br /> <br />A. By executing this AGREEMENT the MUNICIPALITY understands that it: <br /> <br />I . May not apply for grants from appropriations under the Small Cities <br />or State Community Development Block Grant (CDBG) Programs <br />for fiscal years during the period in which it participates in the <br />AUTHORITY's CDBG program; and <br /> <br />2, <br /> <br />May participate in a Home Investment Partnership Act (HOME) <br />Program only through the AUTHORITY. Thus, even ifthe <br />AUTHORITY does not receive a HOME formula allocation, the <br />MUNICIPALITY cannot form a HOME consortium with other local <br />governments. <br /> <br />B. Both the AUTHORITY and MUNICIPALITY are obliged to take all <br />actions necessary to assure compliance with the AUTHORITY's <br />certification required by section 104(b) of Title I ofthe Housing and <br />Community Development Act of 1974, as amended, including Title VI of <br />the Civil Rights Act of 1964, the Fair Housing Act, section 109 of Title I of <br />the Housing and Community Development Act of 1974, and other <br />applicable laws, The AUTHORITY is prohibited from funding for <br />activities, in or in support of, any cooperating unit of general local <br />government that does not affirmatively further fair housing within its own <br />jurisdiction or that impedes its actions to comply with its fair housing <br />certification. This provision is required because noncompliance by the <br />MUNICIPALITY may constitute noncompliance by the AUTHORITY <br />which can, in turn, provide cause for funding sanctions or other remedial <br />actions by the Department <br /> <br />C. The MUNICIPALITY has adopted and is enforcing: <br /> <br />L <br /> <br />A policy prohibiting the use of excessive force by law enforcement <br />agencies within its jurisdiction against any individuals engaged in <br />non-violent civil rights demonstrations; and <br />
