No person shall operate any restaurant, cafe, public dining room or <br /> <br />eating house unless it is at all times clean and sanitary, and all requirements of this Subsection <br /> <br />and other applicable provisions of this Code and State law have been fulfIlled. <br /> <br />Subd. 2 Authority of Health Officer. If upon investigation of any restaurant, cafe, dining <br /> <br />room or eating house, the Ei!1's.desig1}ilt~~ health officer fInds violations of this Chapter or <br /> <br />other applicable provision of this Code, he or she shall notify the owner, proprietor or <br /> <br />manager in writing stating the condition to be corrected and stating a reasonable time [not less <br /> <br />than forty-eight (48) hours] in which the correction shall be made. Failure to comply with the <br /> <br />notice shall constitute a violation of this Subsection. <br /> <br />Subd. 3 Physical Examination of Food Handlers. It shall be unlawful for any person to <br /> <br />engage in the handling and/or sale of food or food products or allow any person to be so <br /> <br />engaged if his or her condition is such that disease may be transmitted by him or her to others <br /> <br />either directly or indirectly. Upon receipt of a complaint or whenever deemed necessary by <br /> <br />the health officer, a special physical examination may be required of any person so engaged. <br /> <br />'State law references-Food law, M.S.A.
