<br />.. <br /> <br />e <br /> <br />e <br /> <br />- <br /> <br />.5 /a~ <br /> <br />STATE OF MrNNESOTA <br /> <br />COUNTY OF RAMSEY <br /> <br />CITY OF ARDEN HILLS <br /> <br />FIRST AMENDMENT TO <br />AMENDED SPECIAL USE PERMIT--CASE NO. 75-6 <br /> <br />The undersigned, the Clerk-Administrator of the City <br /> <br /> <br />of Arden Hills, acting pursuant to action taken by the Arden <br /> <br /> <br />Hills City Council at its meeting on December 13, 1976, does <br /> <br /> <br />hereby amend the Amended Special Use Permit with respect to <br /> <br /> <br />Arden Manor (Case No. 75-6) in the following respects: <br /> <br /> <br />1. Change of Designated Permitee. Whenever the <br /> <br />term "Perrnitee" is used in said Amended. Special Use Permit it <br /> <br />shall be deemed to refer to 550 ASSOCIATES, a Minnesota partner- <br /> <br />ship consisting of DANIEL R. VAUGHAN, FRANCIS A. HUSNIK, <br /> <br />RAYMOND DYKEMA and REAL EQUITIES FINANCIAL CORPORATION, a <br /> <br />Minnesota corporation, which shall hereafter be the Permitee <br /> <br />of said Permit unless and until such time as the property <br /> <br />covered by said Permit is redeemed by the original Permitee, <br /> <br />TWIN PARKS, INC., a Minnesota corporation, or any assignee <br /> <br />thereof. <br /> <br />2. Amendment to Section ~. B. Section I. B. of <br /> <br />said Permit is hereby amended by adding thereto the following <br /> <br />language: <br /> <br />II In the event the perpetual easement <br />for the operation and maintenance of <br />such park and ingress to and egress <br />from the same is not executed and <br />delivered to the City within thirty <br />(30) days after fee title to the <br />development tract, including the <br />park area, has passed to Permitee, <br />this Permit shall be voidable at the <br />option of the Council.of the C~ty." <br /> <br />3. Amendment to Section I. C. 5. Section I. C. 5. <br /> <br />is hereby arnende~ t~ read as follows: <br />
