Mr. Ringwald stated Staff <br />would be. <br /> <br />Commissioner Galatowitsch referred to the language in tlJe draft Ordinance which states "public <br />or private educational facility principally serving persons age 17 or younger," and asked if this <br />was included so as not to eliminate the Bethel College property. Mr. Ringwald stated tlJe <br />language was included to prevent an adult use business being opened near High Schools or <br />younger students. He indicated tlJe Ordinance is not attempting to protect adults from tlJese type <br />of uses as adults are considered old enough to determine what is good or bad for themselves. <br /> <br />Commissioner Duchenes suggested that Staff should look at the Comprehensive Land Use Plan <br />to determine if any changes in the zoning would affect tlJe Ordinance. She asked if other areas <br />could become zoned B-1 or B-4. Mr. Ringwald stated the place to keep an eye on would be the <br />Twin Cities Army Ammunition Plant (TCAAP) as it develops. <br /> <br />Commissioner Duchenes referred to the Assembly of God Church in Shoreview and asked if they <br />would have any standing to object to tlJe building of an adult establishment in the Dunlap Street <br />area. Mr. Miller stated that he could not think of any basis which they would have. <br /> <br />Commissioner Nelson asked how the City would treat rezonings affecting the B-1 or B-4 <br />districts in ten to 20 years. Mr. Ringwald explained that this would be part of Staff's, the <br />Planning Commission's, and the City Council's responsibility when considering rezoning. When <br />reviewing a rezoning request and all of its uses, one of the things which is considered is what <br />would be tlJe worst use that could occur within a particular zoning district. <br /> <br />Acting Chair Rye stated that there was no specific action required by tlJe Planning Commission <br />with regard to the draft Ordinance. Mr. Ringwald concurred and stated that Staffwill incorporate <br />the Planning Commission's comments. The draft Ordinance will then be published in tlJe City's <br />Official Newspaper so that a public hearing can be held on this issue at tlJe Wednesday, February <br />3, 1999, regular meeting of the Planning Commission. <br /> <br />Acting Chair Rye summarized the questions Staff is being asked to review. <br /> <br />1. Clustering (whether tlJere are internal setbacks found between the individual uses and <br />setback requirements from other uses). <br /> <br />2. The impact of a day care opening near an adult use establishment. <br /> <br />3. Is tlJe area proposed for adult use sufficient witlJ tlJe Bethel College area, without <br />considering the TCAAP area, and would the amount ofland still be sufficient if the <br />Bethel College area was not included. <br /> <br />4. <br /> <br />Regulating the number of licenses and the cost oflicensing. <br /> <br />s. <br /> <br />Whether or not a mini-mall type area is acceptable. <br /> <br />6. Review tlJe definitions to ensure tlJey are consistent with Crystal's and St. Paul's <br />Ordinances. <br />
