He pointed out that an upstairs addition to the applicant's current <br />structure would add only 360 additional square feet for a total of 1,080 square feet. The <br />applicants were hoping to achieve a total square footage of 1,440 square feet. <br /> <br />Commissioner Baker stated that he had a problem with intensifYing the variance requirements on <br />the property. It was his understanding that non-conformities were expected to go away over <br />time. If this expansion is allowed it would be adding to the non-conformity, which may not <br />serve the neighborhood. <br /> <br />Commissioner Baker noted, however, the buildable area would have a restricted width of only <br />12.5 feet of buildable space. <br /> <br />Chair Erickson asked if any of the buildable area is in contact with the current home. Ms. <br />Randall indicated that it was not. <br /> <br />Cornmissioner Nelson asked if the homes to the north of the applicant's propertY meet the <br />setback requirements. Ms. Randall stated that generally they meet the frontyard setback <br />requirement . <br /> <br />Commissioner Nelson asked if the Staff had discussed other options with the applicants. Ms. <br />Randall indicated that there were not many other options available. She stated that she had <br />discussed how to maintain the five-foot minimum set back, not how to build the structure. <br /> <br />Commissioner Nelson expressed his concem for the ability to continue into the buildable area. If <br />the existing structure were removed and the entire home were moved back into the buildable area <br />there would still be a concern for how far the structure could be continued. Ms. Randall agreed <br />and noted this would be a similar issue with the adjacent lots. <br /> <br />Commissioner Nelson asked if the applicant had a plan for a garage. Mr. Delich stated that they <br />do not and that they would be willing to sign an agreement to ensure they could not build a <br />garage. <br /> <br />Mr. Delich indicated that they had considered an upstairs addition, however it was not feasible <br />due to the location of the current stairwells. He noted that the home has a strong foundation and <br />there would be no reason to tear the home down. He stated that they would also be willing to <br />sign an agreement that they could not bnild any future additions to the rear of the home. <br /> <br />Commissioner Nelson asked if the Planning Cornmission could require such an agreement be <br />made. Commissioner Sand noted, if the homeowner has the right to build in the buildable area it <br />would be difficult to wave that right. Commissioner Nelson noted that such an agreement would <br />not be transferable to a new owner. <br /> <br />Mr. Delich reiterated that he would prefer not to destroy the current home since it is a nice <br />structure. Additionally, the width of the buildable area would substantially limit the width of a <br />new home. <br /> <br />Commissioner Sand asked if the applicants had considered attempting to purchase the property to <br />the south. Mr. Delich indicated that this propertY owner had approached them about buying their <br />
