<br />'. <br /> <br />~ <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />CITY OF ARDEN IllLLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />April 21, 1999 <br /> <br />TO: <br /> <br />Mayor and City Council <br />Brian Fritsinger, City Administrato~ <br />Tobacco Ordinance #310 <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Requested Action <br />The City Council is asked to adopt Ordinance #310, "Relating to the Sale, Possession and Use of <br />Tobacco Products, and Tobacco Related Devices in the City of Arden Hills." <br /> <br />Backl!round <br />In late 1997, the State of Minnesota created a law which regulates the selling and use of tobacco <br />products. This bill was primarily focused on keeping tobacco products out of the hands of youth <br />and requires cities to adopt ordinances which meet its intent. <br /> <br />At that time, even though the City did not have an ordinance in place, the City Council voted <br />unanimously to join the North Suburban Tobacco Compliance Project (NSTCP). This <br />organization works in cooperation with the Ramsey County Sheriff's Department to ensure that <br />licensed tobacco vendors are meeting the requirements of State law. This is primarily done <br />through compliance checks. <br /> <br />City staffhas been working with the City Attorney to develop an ordinance which addresses the <br />requirements of the State law. <br /> <br />Have Current Licensees been Noticed of the Proposed Ordinance? <br />The law requires that at least a thirty (30) day notice to licensees be given prior to amending our <br />ordinance. As part of the 1999 Business License renewal process, staff notified licensees that the <br />City was expected to consider an ordinance within sixty (60) to ninety (90) days. Formal notice <br />was provided the week of March 15, 1999. <br /> <br />Does the City Currentlv have a Tobacco Ordinance? <br />The City does not have a current ordinance specific to the sale and use of tobacco. Tobacco sales <br />are licensed by the City under a different section of the C~de. <br /> <br />What is the Fee for Licensinl: Tobacco Vendors? <br />The City, in 1997, increased the fee for a tobacco license to $200.00 per year. This was done to <br />offset the costs of completing compliance checks and other sections of the new law. Staffis not <br />recommending any changes to the fee structure at this time. <br />
