e

DATE: March 15,1999

RE: Arden Hills Tobacco Ordinance

Dear Cigarette Retailer:

NOTICE

Your business has been identified as one which may be selling cigarettes through the use
of vending machines or through over the counter retail sales. This letter is to inform you
of a law which was adopted by the Minnesota Legislature that affects the sale, possession,
and use of tobacco-related devices.

Minnesota Laws (1997), Chapter 277, bans the use of vending machines in all
facilities except those which cannot be entered by minors. This law became effective
August 1, 1997. It has been determined by legal analysts that this ban does apply to bars
and liquor establishments. As a result, please be aware that the City of Arden Hills will
begin enforcement of this provision of state law in 1999.

The City Council is also required to adopt a new ordinance related to the retail sale of
cigarettes. This ordinance will be reviewed by the City Council at its April 26, 1999
meeting, and you are welcome to attend this meeting to leam more about the proposed
ordinance. I have enclosed a copy of the proposed ordinance for your review.

e

Should you have any questions on this law, or Arden Hills' enforcement of the law, please
feel free to contact me.

Sincerely,

Brian Fritsinger
City Administrator

CC/Kevin Ringwald, Assistant to the City Administrator
Nancy Randall, Associate Planner
City Council

e
